‘Are you f*****g mad, Oscar Pistorius?’

“My lady, I apologise for my language but I asked if he was fucking mad.”

This was what Darren Fresco today told Judge Thokozile Masipa in the murder trial of Oscar Pistorius today. He was testifying about the incident in which Pistorius had allegedly fired a gun, out of the blue, through the sun-roof of a vehicle he was travelling in with Fresco and ex-girlfriend Samantha Taylor.

This was after they had been at the Vaal for a day and, according to defence advocate Barry Roux, travelled at 260km/h in an unlicensed vehicle, were pulled over by cops twice and were apparently involved in a high-speed car chase with police.

Fresco, with shoulder-length hair and dressed in a suit with a pink dress shirt and shiny shoes, told the court that he remembers travelling to someone’s house after the day at the Vaal and that they then went to a restaurant, the Gourmet Garage. He doesn’t remember the time.

“I can tell you that, on the way, we saw a beautiful sunset,” he said.

Also, Fresco apparently lost his memory entirely after eating at the restaurant.

Asked what they did afterwards, he said he could not remember.

Roux asked how it was possible that he “could recall events in the morning but after that you just go blank?”

Fresco maintained he could not remember.

He also did not recall travelling at 260km/h, nor did he recall discussing shooting a robot with Pistorius before Pistorius shot his firearm through the sunroof.

This contradicts testimony be Pistorius’ ex-girlfriend, Taylor, who said that Freso and Pistorius were annoyed about being pulled over by police and had discussed shooting a robot in revenge.

Fresco also testified about a separate incident in which Pistorius had asked him for his gun at Tashas. restaurant in Melrose Arch, Joburg.

He said he was confident giving Pistorius the gun because they had been to shooting ranges together and he knew Pistorius had a “big love for weapons”.

When the gun went off, testified Fresco, there “was the most deafening hush you’ve ever heard”.

He said Pistorius had asked him to take the rap, which he was willing to do because he was a friend.

Crucially, Roux has pointed out that Fresco did not put the fact that Pistorius asked him to take the rap in the original statement he had made with the aid of an attorney.

He “could not say” why he had omitted to do so.

Fresco is a Section 204 witness, which means he will not be prosecuted for any crimes he is implicated in, provided he gives honest testimony.
