Concourt NPA case ‘not urgent’ – judges

The Constitutional Court rejected a request to urgently hear a case regarding the appointment of a permanent head of the National Prosecuting Authority (NPA).

Civil rights organisation the Council for the Advancement of the South African Constitution (Casac) submitted an application earlier this week to Chief Justice Mogoeng Mogoeng.

Afrikaans daily Beeld reported today Casac argued that President Jacob Zuma’s delay in appointing a permanent NPA head was unconstitutional and asked the Constitutional Court to force Zuma to make the appointment within 30 days.

It wanted the court to hear the matter urgently on August 1.

The court yesterday rejected the request for urgency, saying the respondents – Zuma, Justice Minister Jeff Radebe and acting NPA head Nomgcobo Jiba – had until July 24 to submit responding affidavits.

The prosecuting authority has been without a permanent head since the Supreme Court of Appeal set aside Zuma’s appointment of advocate Menzi Simelane as NDPP in 2011.
