Farmer’s 10-year-old case back in court

2010-09-18 08:09

The trial of a 10-year-old attempted murder case against a Wolmaransstad farmer is due to start next week.

Frans Marx will appear in the Wolmaransstad Regional Court in North West on Monday to face charges of attempted murder, pointing a firearm and defeating the ends of justice, said NPA spokesperson Mthunzi Mhaga in a statement yesterday.

“The allegations are that in December 1997, two African adult male persons were walking along a farm road in the district of Wolmaransstad when six white males stopped their bakkie in front of them and enquired where they were going,” said Mhaga.

“Before they could respond, they were allegedly beaten and taken to a local police station. One man was so severely assaulted that he lost his eyesight permanently.”

The two only received medical treatment after their fellow inmates notified the authorities of their condition.

They spent six weeks in hospital under police guard as Marx had opened a case of assault against them.

The case was later withdrawn due to a lack of evidence.

“Upon their release, the two men laid charges against their assailants which were declined by two senior prosecutors,” said Mhaga.

The two men then approached the National Director of Public Prosecutions who then overturned the previous decision and ordered Marx’s prosecution.
