Judge for yourself - is Ngcobo the right man?

WHAT now for controversial Judge John Hlophe and the Justice for Hlophe

Alliance which unprecedentedly lobbied for him to be appointed chief justice of

the country

The nomination of Justice Sandile Ngcobo to succeed Chief Justice Pius Langa

certainly ends speculation as to who the next chief justice will be.

However, the question remains: is Ngcobo the right man to lead the

Constitutional Court?

Some argue so his detractors are quick to remind us that he is the same man

who was appointed to the court instead of Judge Edwin Cameron through the

intervention of former president Thabo Mbeki, and has now been nominated because

of his dissenting judgment in the matter of Zuma and the national director of

public prosecutions, in which the former was challenging the lawfulness of the

search warrant of his Forest Town home.

Be that as it may, the tradition has been that the deputy chief justice

succeeds the chief justice upon retirement. Is the statement by Justice Dikgang

Moseneke made at his birthday party that he owes allegiance to the rule of law

and not the ruling party coming back to haunt him? Zuma himself made a remark

that he took this statement very strongly and would remember that when making

the appointment.

One now wonders what disqualifies Moseneke to be nominated as our next chief

justice considering the fact that he has shown himself to be an astute jurist

with impeccable struggle credentials and has leadership quality.

Why was Ngcobo preferred over Moseneke? You be the judge.
