NPA reports Jiba, Mrwebi for not helping probe

The National Prosecuting Authority has reported two senior officials to the justice minister after they refused to participate in a probe at the authority.

NPA spokesperson Nathi Mncube said a memorandum over deputy NPA head Nomcobo Jiba and national head of the specialised commercial crime unit, Lawrence Mrwebi, was sent to Justice Minister Michael Masutha.

The NPA is waiting for Masutha’s response, Beeld reported today.

Masutha’s spokesperson Mthunzi Mhaga confirmed receiving the memorandum from NPA head Mxolisi Nxasana, but would not say more.

According to Mncube, retired judge Zak Yacoob, who is conducting the probe, did not have the authority to summon Mrwebi and Jiba to appear before him.

Yacoob’s role was to collect facts, and conduct a preliminary inquiry with recommendations. He has handed this to Nxasana.

Mrwebi, Jiba and advocate Sibongile Mzinyathi, director of public prosecutions for North Gauteng, were involved in the withdrawal of charges of fraud, money laundering, and corruption that Lt-Gen Richard Mdluli had faced when head of the police’s crime intelligence division.

The High Court in Pretoria set aside their decision and the appeal court confirmed the decision.
