Nhleko appeals Dramat ruling

Few hours after the North Gauteng High court ruled that the suspension of Hawks boss General Anwa Dramat is “unlawful and invalid”, Police Minister Nathi Nhleko has instructed his legal counsel to appeal against the decision.

Nhleko's attorney William Mokhari told City Press this afternoon that the decision has already been appealed.

“We have received instructions to appeal the ruling. We have already submitted the documents and we are prepared to go to the Constitutional Court if that’s what it takes,” he said.

Mokhari said they are of the view that the North Gauteng High Court Judge Bill Prinsloo erred in his ruling and a different court may reach a different conclusion.

In a terse judgment delivered this morning, Judge Bill Prinsloo also set aside Police Minister Nathi Nhleko’s appointment of Major General Berning Ntlemeza as the Hawks’ acting national head.

Judge Prinsloo ordered Nhleko to pay the Helen Suzman Foundation’s costs. The foundation filed the urgent application seeking Dramat’s reinstatement and the reversal of Ntlemeza’s appointment.

The foundation’s head, Francis Antonie, said Nhleko’s suspension was a pure violation of the law and that the foundation felt vindicated by the ruling.

“We are pleased that the rule of law has been restored and we hope the minister will act accordingly and respect the ruling,” said Antonie.
