Richard Mdluli back in the hot seat

The Supreme Court of Appeal (SCA) has ordered that criminal charges against former crime intelligence boss Richard Mdluli be reinstated.

The SCA ordered that the decision of the National Prosecuting Authority (NPA) to withdraw charges of corruption and fraud against Mdluli be set aside.

It also ruled that the decision by the national police commissioner to withdraw disciplinary proceedings against Mdluli – and to reinstate him – be revoked.

With regard to the charges of murder, assault and kidnapping against Mdluli – related to the death of Oupa Ramokgibe, the husband of Mdluli’s former lover – the court gave the NPA two months to decide with what charges it would proceed.

The NPA has also been ordered to provide Freedom Under Law, the respondent in the appeal, with reasons for its decisions in terms of these criminal charges.
