Still no proof Juju resigned as company director

2010-03-02 12:21

JULIUS Malema’s lawyer has yet again failed to provide documentary

proof that he or any other attorney representing the ANC Youth League president

instructed the Companies and Intellectual Properties Registration Office (Cipro)

to remove him as a director of four companies.

The only document Tumi Mokwena, Malema’s Polokwane-based lawyer,

presented at a press conference today was a print-out from an online database

which indicates that Malema’s directorships are “in the process of being

de-registered”.

Mokwena was unable to answer questions about why the process was

taking nearly two years to complete when a Cipro spokesperson is on record as

saying de-registration of a director normally takes 15 days if there are

backlogs.

Asked why he could not present a letter, fax, email or a print-out

proving that he had asked Cipro to remove Malema as director of 101 Junjus

Trading, Blue Nightingale Trading 61, Ever Roaring Investment and SGL

Engineering Projects, Mokwena said:

“We are not here to prove Cipro’s

incompetence. If you want to show Cipro’s incompetence then that should be your

baby, you should take it up. Do not use Malema’s case to show Cipro’s

incompetence.”

He said he had not received instructions from his client, Malema,

to reveal documents relating to the de-registration process. “Mr Malema has not

given me an instruction to do that. It is his file, it his his

prerogative.”

Mokwena later claimed he had personally completed an online

application to have Malema removed as a director.

ANCYL spokesperson Floyd Shivambu, who peppered his statements with

sarcastic attacks on reporters including a City Press journalist he referred to

repeatedly as an “alleged investigator” said: “It is clear that Cipro has been

instructed.

The proof is here. It (the print-out) is saying ‘this is in the

process of de-registering’.”

Shivambu told the assembled members of the media: “We want to

clarify these things, there is nothing to hide. We do not want you to go out of

here and say things were not clarified.”
