‘Unrealistic’ that job chances will sway judges

The perception that a chief justice would view cases before him or her according to whether his term of office would be extended was “totally unrealistic”, advocate Kemp J Kemp said in the Constitutional Court today.

He was defending President Jacob Zuma’s decision to extend the term of office of Chief Justice Sandile Ngcobo, and disagreed with an urgent application that it was unconstitutional for Zuma to have done so by himself.

Kemp rejected a suggestion earlier by Judge Johan van der Westhuizen that judges looking for an extension, or not, would work differently.

Kemp said section 8(a) of the Judges Remuneration and Conditions of Employment Act gave the president the discretion to appoint a chief justice, or extend his or her term.
