Victim was my mistress, alleged rapist claims

2011-02-07 14:59

Alleged serial rapist and murder accused Jack Mogale claimed in the South Gauteng High Court in Johannesburg today that a woman he is accused of raping was his mistress.

His lawyer Buhle Madondo told the 29-year-old woman testifying against his client that Mogale would tell the court they had been “an item” since late 2007.

Mogale faces numerous charges, including 19 counts of rape, 16 of murder and 18 of kidnapping.

The woman, who cannot be named due to the nature of the alleged crime, told the court that in December 2008 Mogale claimed to her he was a prophet and a Zion Christian Church preacher, sent by God to cure her of an illness of the uterus with a “holy tea”.

He followed her home and suggested she give him cash to buy herbal tea to heal her. She gave him R150, but refused to go with him as it was late and told him to return the next day. He replied that he would bring her change if there was any.

She said Mogale, who she had met a day before the alleged rape, also told her she needed to have sex with him to rid her of an evil spirit that had been having intercourse with her at night.

He allegedly took her to a bush in Lenasia where he claimed the evil spirit needed to be expelled from her body through sex. He first gave her the tea to drink, which made her dizzy.

When they got to the bush Mogale allegedly told her to put tea leaves in her genitals, then raped her.

However, Madondo dismissed the woman’s testimony and said the sex was consensual. Mogale denied the woman’s version of events, said they were an item and had intercourse at her place in Lenasia on the day of the alleged crime, Madondo said.

The case continues.
