Woman sues police

An Eastern Cape woman is suing the police for R1.5 million after her cop husband shot her and then shot dead himself six years ago.

The Dispatch Online reported the mother of four, Ntombenkosi Hlomza (36) of Transkei, was married to Bongani Hlomza (43), a warrant officer at Madeira police station in Mthatha at the time.

In court papers, her lawyer, Nceba Dukada SC, said the police was negligent and failed to act even though it was known that Hlomza had threatened his wife and had suicidal tendencies.

“They became aware that the deceased had threatened to shoot his wife, but failed to take steps to seize the official firearm from the possession of the deceased,” read the court documents.

Some R60 000 of her claim is for funeral costs incurred after the incident at Mthatha police camp on February 13, 2005.

But Advocate Selby Mbenenge SC, representing the police, denied that the his suicidal tendencies were known.

However, he admitted that the police were aware of him being violent against his wife.

Judgment was reserved.
