Alleged rapist took photos of her private parts, says teenage witness

A TEENAGER, who was 13 when she alleges she was assaulted, held at knifepoint and raped in a forest by Faizel Sayed (35) of Howick West, who faces 29 charges including murder, kidnapping, rape and robbery, revealed under cross-examination that Sayed also allegedly took photographs of her private parts with his phone after the rape.

The teenager was asked by Sayed’s advocate, Louis Barnard, why she failed to tell the court about the alleged photographs when she gave her evidence. She responded that she had forgotten.

She told Acting Judge Ben van Heerden and two assessors that this did happen.

Challenged to explain why she left out the fact that Sayed was armed with a knife in the first two statements she had made to police, the teen said she was “frightened” when she made the statements and said she was still frightened to look at the accused in the dock.

In her evidence she said she “felt” Sayed put a sharp knife to her lower back while threatening to kill her when she would not undress, but testified that she never saw the weapon.

However, under cross-examination, Barnard said, in a third statement the girl had made to police she did mention a knife and stated it was “like a dagger” as if she had seen it.

He also questioned her evidence that she was a virgin when she was raped, as medical evidence confirming that Sayed’s semen was found inside her had also detected semen from another male.

“I know nothing about that, but I know that he was the person who slept with me,” the teen responded.

The teenager testified that she came to Pietermaritzburg on Sunday, June 1, last year to buy a calculator.

In Pietermaritz Street, a white Golf stopped next to her and Sayed got out of the passenger seat. She said he told her he wan­ted to offer her a job selling airtime at school and promised to give her a cellphone. She agreed, but when he suggested she get into the car she refused.

The teen said he then “grabbed” her, covered her mouth with his hand and pulled her into the back seat. He locked the door, jumped into the front passenger seat and the car drove off.

“I asked where they were taking me but they didn’t respond. I then started crying,” she said.

When they got to a forest, the car stopped and she and Sayed alighted. “I wanted to get out of the vehicle … I was scared,” she said.

The teen said she started walking back towards town, but Sayed pulled her back. He took her into the forest and told her to get undressed. She refused and turned her back on him and, at that stage, felt the knife against her back.

The teen testified that she tried twice to run away, but Sayed caught her and slapped and punched her across the face “many times”.

Sayed also tried to force her to perform oral sex, she said. She bit him and he assaulted her again.

She said when Sayed left to urinate she put on her clothes and fled. She got to a road where she stopped a car and a man took her to the police to open a rape case. She was medically examined the same day.
