Attacker ‘was naked’

2015-02-12 00:00

AN elderly woman has described how she emerged from her bathroom and came face to face with her alleged rapist, naked in her bedroom, in 2012.

The victim was admitted to the intensive care unit at a private hospital for about a week after the incident.

The woman, who is now 77-and-a-half years old, gave evidence yesterday before Judge Anton van Zyl from a convalescent home where she is recovering after being severely injured in a recent fall.

Court officials and the rape accused, guarded by a policeman, sat at tables around the bedridden victim while she told her story. A screen separated her from the accused.

The woman has identified the accused, Mduduzi Phenyane (33) of Westgate, as her attacker.

The court heard the woman previously pointed Phenyane out as her rapist at a police identity parade, and she again pointed to him from her bed yesterday saying, “That’s him”.

“I would still like to know why,” the woman said at one stage during her testimony, a source told The Witness.

She unfalteringly described how on the morning of August 25, 2012, she was showering in her granny flat, which adjoins her daughter’s home, when she heard a sound outside.

She got out of the shower and got dressed.

Emerging from the bathroom, she was confronted by a naked man waiting for her in her bedroom.

The attacker grabbed her around her neck and began throttling her so that she could not breathe.

The victim said she had tried to squeeze her hand in between his hands and her throat to get some air.

The man threw her to the floor and “ripped or cut” her clothing off. He then raped her.

Whenever she moved to get up, the rapist punched her in the chest.

He had also kicked her and stabbed her with a pair of scissors during her ordeal.

She suffered an injury to her forehead, a stab wound below the collar bone and superficial stab wounds on her wrist.

After the rape, the man moved to the kitchen, got dressed and then searched the flat for valuables.

Before fleeing, he took his victim’s wallet with R460, her sewing machine and cellphone.

Phenyane has pleaded not guilty to charges of housebreaking with intent to rob and robbery with aggravating circumstances, rape and attempted murder in connection with the incident.

The trial is continuing.
