Bar brawl accused given bail

RAMSGATE magistrate Elise Coetzer granted bail to Petrus Opperman and Carel Volschenk, after finding that the state’s case against them appears to be “not as strong as it initially was”.

Opperman and Volschenk, together with Jakes Putter and Douw van der Walt, are accused of the fatal assault of Lwandile Mampofu (26).

The incident apparently occurred after an altercation over a cigarette broke out in the Lighthouse Pub and Grill in Margate.

Mampofu died in hospital.

The court was told of statements that had not been included in the police docket.

“There are statements that nobody knows about,” said Coetzer.

The state presented “new evidence” that could possibly prove that it had never misled the court during the initial bail application hearing.

The defence claimed that the state has misrepresented evidence in court and that after going through the docket, certain discrepancies in the eyewitnesses’ statements are evident.

Investigating officer Wiseman ­Khoza stated that certain aspects of his testimony given in court at the initial bail hearing were derived from “hearsay evidence”.

“I did not take the statements from the witnesses at first.

“I therefore interviewed them myself after reading the statements taken from another police officer …” said Khoza.

He said that was where he obtained certain information.

Khoza told the court his investigation of the matter is continuing.

Defence attorney Christo van Vuuren said that the matter is not a trial and is becoming lengthy and drawn out.

“This bail application is becoming a circus,” he said.

The hearing was adjourned to November 3 pending further investigations.
