Crash case postponed

THE trial of 26-year-old Thamen­dren Pillay arising from death of a ­Pietermaritzburg couple in a 2012 car crash in Bombay Road, was­ ­yesterday postponed until July 28.

Pillay faces two charges of culpable homicide in connection with the deaths of Thamandree and Barry Christopher Pillay.

He is not related to the victims.

The couple were killed when the Opel Astra driven by Pillay allegedly crashed into them as he tried to overtake another vehicle on December 16, 2012.

Pillay’s attorney Sergie Brimiah confirmed in court yesterday that the defence and state had tried to negotiate a plea bargain, but said the negotiations failed.

Due to the fact that state prosecutor Ricky van Wyk had now also added more charges to the original charge sheet, the defence needed further time to prepare for trial.

In addition to the two counts of culpable homicide, Pillay now also faces charges of defeating the ends of justice, reckless and negligent or inconsiderate driving, failing to render assistance to victims of an accident and driving without a licence.

Regional court magistrate ­Bhekizitha Phoswa said although the family of the victims and state witnesses may be concerned about the further delay in the trial, it was unavoidable.

The case was postponed to ­July 28 and 29 for trial.
