DA: Give reasons for dropped charges

2012-08-29 00:00

THE Democratic Alliance will submit a public access to information application if the National Prosecuting Authority (NPA) fails to disclose the reasons why it dropped charges against ANC politicians Mike Mabuyakhulu and Peggy Nkonyeni.

KZN DA leader Sizwe Mchunu said he had written to the provincial acting Director of Public Prosecutions, advocate Moipone Noko, demanding that the NPA immediately release the records of its decision to drop charges of fraud and corruption against the two politicians. “Three days later the NPA acknowledged receipt of my letter and advised that a response would follow ‘in due course’,” Mchunu said.

He added that this was not good enough and the NPA must treat this matter “with the magnitude it deserves”.

“These records are public property and there is no good reason why they should not be made immediately available. Yet it appears that the NPA is prepared to play the waiting game, not only with the DA, but also with KwaZulu-Natal citizens,” Mchunu said.

He added that it was highly suspicious that the politicians should be cleared, while their co-accused government officials are on suspension and face judgment.

Mabuyakhulu and Nkonyeni were charged with 17 others in a case involving an allegedly corrupt tender awarded to Uruguay businessman Gaston Savoi’s company Intaka for water purification plants.

The NPA was contacted, but did not respond by the time of going to press.
