Damage rap: Dirks's lawyer pulls out

2011-09-29 00:00

FORMER Msunduzi deputy mayor Marvyn Dirks failed to pay his lawyer, who has withdrawn from the hearing into a charge Dirks faces of malicious damage to property.

Dirks (47) of Woodlands is charged with damaging the property of Musawenkosi Agrippa Zondi in Ntuthukoville Drive in Woodlands.

The charge sheet states that he damaged a window valued at R18 at Zondi’s home in July 2011.

Simphiwe Ngwenya, who was standing in for Diamond Chandra, told the Pietermaritzburg Magistrate’s Court that he is “not placed in funds” and he is withdrawing as Dirks’s lawyer. Sibani Nzimande stepped in as a new lawyer and asked for a postponement, saying he needs the statements so that he can prepare for the trial.

Magistrate Raymond Kunene accepted Nzimande as a new lawyer and granted the postponement until October 12 for statements and will then set a trial date.

Police spokesperson Lieutenant Joey Jeevan said the matter is sub judice and police cannot comment.
