Damages for rape victim

THE Minister of Police must pay R8,8 million to a former attorney from Welkom after a serial rapist, who had escaped from police custody at the magistrate’s court, raped her in her home.

Judge Albert Kruger in the high court in the Free State yesterday ruled that the minister must pay the victim R6,8 million for loss of past and future income, R483 700 for future psychiatric treatment and R1,4 million for medicines.

The minister must also pay her legal fees and the costs of six expert witnesses.

Advocate Adriaan Vorster from Pretoria represented the rape victim while advocate Peter Fischer SC, represented the minister.

The attorney (30) is now jobless and suffers from high levels of stress after she was assaulted, overpowered and raped at her home almost four years ago by Petrus Khotso Kalao (30).

She told Judge Kruger she had nightmares and could not sleep for up to a week at a time, despite using strong sleeping tablets that had been prescribed to her.

The expert witnesses testified that it was unlikely that the attorney would be able to function in a normal work environment in future.

Kalao had on August 3, 2009 sauntered casually out of the court room, presumably without any police officers noticing. The attorney had been in the same court room shortly before Kalao escaped and he was pointed out to her as a serial rapist who had attacked three women.

They had not made eye contact.

Kalao was lying in wait for the attorney at her home when she arrived late from work on the Friday night of August 7. He was found guilty on 15 charges, included five of rape, and sentenced to 135 years’ imprisonment in September 2011, of which he will effectively serve 45 years.

Two weeks after he had raped the attorney, he also attacked a neighbouring woman.

He was to apply for bail when he walked out of the court room. The charges against him then were that he had raped three women, of whom two were in their 20s, and one 40 years old. He had overpowered all of them at their places of work at the President Brand gold mine. Apart from raping the women, he also robbed them after assaulting them.

Kalao was already on bail after being arrested on several other charges when he raped the three victims.
