Department challenges order to pay manager R100?000

THE KwaZulu-Natal Education Department is seeking legal advice to challenge a decision by the arbitrator that it must pay R100 000 for unfair labour practice in not promoting an employee to manager of the Ugu district.

This follows a dispute between the department and Skhumbuzo Maphumulo, who challenged the decision not to appoint him as Ugu district manager.

Mfundi Sibiya was appointed district manager in 2007.

He and Maphumulo were both interviewed for the position. Maphumulo, who said he has served the department for 32 years, challenged the decision, claiming that Sibiya was less experienced than him to hold a senior position.

Arbitrator Harold Mdineka ordered the appointment of Maphumulo to district manager with effect from June 2010.

He also ordered the department to pay R100 000 to Maphumulo.

Maphumulo, who was then a chief education specialist, a position equivalent to deputy manager, was acting Ugu district manager during the review while

Education spokesperson Sihle Mlotshwa said the case has been sent back to the labour court for review.

“For now we cannot implement anything until the review process is over,” he said.
