Dept fails to obey order

THE KZN Roads Department yesterday failed to obey a subpoena ordering the head of department to produce documents in court relating to the tarring of a road to the Albert Falls farm of national Transport Minister, S’bu Ndebele.

The documents have been subpoenaed by the legal team acting for former chef Hluphile Elda Zuma (53), who lost part of her arm and hand when the minibus she was in struck a pothole and overturned between Keates Drift and Tugela Ferry in December 2004.

It was yesterday agreed by lawyers acting for both sides that the surfacing of the road in question had taken place during the 2004/2005 financial year, which is when Zuma was injured.

It was agreed that documents relating to the road (D173) are to be produced in court on Monday.
