‘Drink drove me to rape woman aged 90’

A 34-YEAR-OLD man who pleaded guilty to raping a 90-year-old woman in Vryheid, as well as to housebreaking and robbery with aggravating circumstances, has been sentenced to life plus 15 years’ imprisonment by Judge Anton van Zyl.

The crimes were committed in the town on December 19 last year.

Themba Cyril Magwagwa said in his statement to court that on that day he attended a function at his uncle’s home in Vryheid to “appease our ancestors”.

He said he consumed Zulu beer and brandy, and said it was the first time he had consumed alcohol as he normally smoked dagga.

Magwagwa said that after he left to go to the room he was renting at Bhekuzulu location, he found himself in the yard of someone’s home.

“I walked up the pathway and I approached the front door, which was open. However, the security gate in front of the door was closed. I pressed the buzzer and someone opened the gate. I entered the house and I found an old white lady sitting in the sitting room. She looked up at me and I asked her for money. She said that she did not have any money.

“I moved towards the complainant and grabbed her, pulling her to her feet and I dragged her to the bedroom. Whilst dragging the complainant to the bedroom I injured her. I said to her that all I wanted was money and she lifted up a table cloth that covered a table and removed the sum of R200, which she handed to me. I then threw the complainant on the bed and raped her once.”

Magwagwa said that after the rape he left the woman on the bed and ransacked the house. He took items from the fridge and alcohol, some of which he consumed there, as well as a jacket, socks and a Nokia cellphone.

“On the way to my home I realised what I had done. I went to the railway line and sat on it and regretted what I had done. From then on I wanted to go and give myself up to the police. However, I was afraid to do so,” he said. “I regret what I have done and I apologise for my actions,” he added.

According to the state’s indictment, the rape victim sustained serious facial injuries in the attack and was severely traumatised.
