Education manager cleared

ON November 16, 2009, The Witness published an article entitled “Auditors can’t find R80 mln” and followed up with an article on November 17, 2009 entitled “Education: Suspensions welcomed”. The articles mentioned that two senior officials of the Education Department, one of whom was Nisha Maikoo, the senior manager in charge of procurement, had been suspended.

Maikoo contended that the article implied that she had been suspended for misappropriation of funds amounting to R80 million and issued summons against The Witness for defamation. The Witness denies the implication contended by Maikoo and defended the action. The action has now been settled and The Witness confirms not only that it did not imply that she was suspended for misappropriation of funds but accepts further that she was not in fact suspended for this reason but as a precautionary measure to enable investigations and that such suspension did not imply that any disciplinary steps would be taken against her.

Maikoo’s attorneys have pointed out that no charges of misconduct were mentioned in the letter of suspension or have ever been proffered against Maikoo and that the suspension was withdrawn on November 20, 2009.
