Farm murders: Trial adjourned after accused hires new attorney

2012-03-27 00:00

THE trial of Mzwandile Magubane (21) who is charged with the farm murders of Lorraine Karg, Hilda Linyane and Shayi Zakius Mhlongo, was adjourned yesterday after he hired a new attorney.

Magubane indicated last week that he was not satisfied with legal aid-appointed attorney Chetna Singh, and said his family was prepared to pay for a private defence attorney.

Yesterday attorney Kabir Thulsiee confirmed that his services have been retained by Magubane’s family for the remainder of the trial.

He also confirmed that he had been paid for the duration of the case, which has been set down to run from July 16 to 27.

Acting Judge M.T. Ncube granted the postponment to enable Thulsiee to obtain a transcript of the evidence in order to pick up the defence case where Singh left off.

Magubane has pleaded not guilty to three counts of murder, attempted robbery and robbery with aggravating circumstances as well two counts of assault with intent to do grievous bodily harm.

He maintains he was at Eshowe at the time of the alleged offences.

The court has heard evidence that Lorraine Karg and her former gardener, Mhlongo, both bled to death after their throats were cut.

Domestic worker Hilda Linyane was shot in the chest when they were attacked by intruders at Sherwood Farm, Mooi River, on the night of July 21, 2010.

The state alleges the occupants of the house had earlier been lured away to fight a fire that was deliberately set in the veld.

The victims were slain after arriving back home unexpectedly to fetch equipment to fight the fire.
