Forgery: court ordely policeman charged

A 43-YEAR-OLD police sergeant made a brief appearance at the Pietermaritzburg Magistrate’s Court yesterday for the first time with his attorney on a forgery and corruption charge.

Sergeant Lucky Biyase, who works as an orderly at the magistrate’s court was arrested on September 26.

Biyase is charged with forging an affidavit reflecting that Vincent Musawenkosi Nxumalo attended court in August 8 and 15. The charge sheet alleges that Biyase acted with intent to defraud or to prejudice the Health Department, ­Nxumalo’s employer.

His attorney, Stanley Ngubane, told the court that he had only just joined the case.

Prosecutor Rene Padayachee asked the accused to make section 220 admissions so that the state will not waste time in analysing the handwriting in the document. But his attorney said he has advised his client not to make any admissions. The state asked the accused to supply a handwriting sample for analysis.

The case was adjourned to November 22. Police spokesperson, Lieutenant Joey Jeevan said because of the nature of the case Biyase is allowed to work while on trial.
