Fraudsters on bail awaiting appeal

CONVICTED fraudsters Dinesh Lutchman and Akashnee Singh will approach the Supreme Court of Appeals (SCA) in a final bid to overturn their conviction for defrauding Rowena Padayachee of her home in Burger Street in 2004.

Judge David Ntshangase yesterday extended Lutchman and Singh’s bail of R4 000 each pending their application to the SCA for leave to appeal against their convictions.

The couple were due to report to the Department of Correctional Services to begin serving their jail terms this week after their petition for leave to appeal to the KwaZulu-Natal high court was dismissed last Friday.

Each of them was sentenced to eight years’ imprisonment, half suspended, by the regional court in 2011 for fraudulently depriving Padayachee of the house which she had inherited from her late mother.

Regional court magistrate Chris van Vuuren, found the couple guilty of having presented a fake deed of sale to an attorney, Vilanthree Naidoo, in a bid to illegally take transfer of the property, which they were renting at that time.

Padyachee testified at the trial that soon after she instructed an agency to evict the couple for not paying rent, she received a call from an attorney asking her to sign transfer papers.

She was shocked as she had no intention of selling the house, which was of great sentimental value to her.

Lutchman and Singh remained in occupation of the house for more than seven years until the conclusion of the trial in December 2011.
