Friend points out alleged child killer

2008-06-03 00:00

A nine-year-old boy yesterday gave evidence in the high court trial of Ematimatolo child murder accused Bonginkosi Aaron Shezi (28), and pointed him out as the man who took his young friend away on the day he disappeared forever.

Shezi has pleaded not guilty before Judge Kate Pillay and two assessors to the murder of three-year-old Nduduzo Mthethwa on August 31, 2004.

The State alleges that Shezi took the child while he was walking home from crèche in the company of a friend, took him to a plantation nearby and killed him by assaulting him on the head.

The prosecution alleges the murder was motivated by Shezi’s feelings of hostility towards the mother of the boy, Nokuthula Mthethwa, who had ended her relationship with Shezi a few months prior to the murder.

Yesterday, Nduduzo’s former schoolfriend — who was five years old at the time of the incident — gave evidence through an intermediary to save him the trauma of giving evidence in open court.

At one stage the boy was asked to enter the courtroom to point out the man who had taken Nduduzo on the day in question, and whom he had referred to as Nduduzo’s “father”.

Judge Pillay instructed Shezi to be seated in the public gallery amidst other members of the public so that the boy would not be influenced by seeing him sitting in the accused’s dock.

The child glanced around the courtroom and immediately pointed at Shezi, and then, in response to questions from the court, described the clothes he had worn.

The case is proceeding.
