Illegal boarding house shut

THE owners of an illegal boarding house at 118 Boom Street were finally interdicted yesterday from using the property as a boarding establishment or student digs.

The area is zoned “special residential”, which means that the property can only be used as a “dwelling or outbuilding”.

Under the court order the owners — Essa Feroz Ismail, Essa Tarmahomed Ismail and Essa Hassam Ismail — are to end the lease agreements in respect of all their tenants, who must leave by July 31.

If anyone refuses to move, the owners were ordered to start eviction proceedings.

In terms of the court order, if the owners do decide that they want to continue operating a boarding house at the premises, they must first submit a re-zoning application to the municipality by August 1.

In an affidavit before court, municipal manager Mxolisi Nkosi said the town planning department had received complaints about excessive noise at the property.
