Judges uphold father-killer’s sentence

High court judges of appeal in Pietermaritzburg yesterday upheld an 18-year jail sentence imposed on a northern KwaZulu-Natal man, Justice Sibusiso Buthelezi, for the “particularly brutal” murder of his own father during 2002.

The murder of the victim, Zwelinjani Buthelezi, who was stabbed several times with a spear and hit with a stick which broke his jaw and disfigured his face, was witnessed by other family members who testified at the trial held in the Eshowe Regional Court.

Acting judges Malcolm Wallis and Colin Mann said that in the circumstances of the case it is difficult to fault the conclusion of the regional magistrate that Buthelezi is a “dangerous person and a threat to society”.

Factors taken into account were that the victim was unarmed; that the attack had been brutal; that alcohol had made Buthelezi aggressive; and that he had shown no remorse over the fact that he had killed his father.

According to the court records, he first assaulted his brother, Velaphi, and when his father intervened, he fetched the weapons and launched a “frenzied” attack on him.
