Lotto winner sues ex

FORMER R10,4 million lotto winner Dayalin Maslamoney is suing his ex-wife, Reena, for a half-share in their former matrimonial home in Chase Valley.

He alleges that he was persuaded to transfer his share of the property to her based on a “misrepresentation” by her that the document he signed related to a verbal agreement they’d reached for her to grant him a R100 000 interest-free loan.

This is contained in a summons issued against Reena Maslamoney by her ex-husband’ s lawyer, Siva Chetty, last week.

According to the summons, the couple married in community of property in February 2000 and their divorce was finalised on February 11 last year.

Prior to their divorce it is alleged that they reached a settlement agreement — which was never signed — in terms of which they agreed their matrimonial home in Chase Valley would be sold and the proceeds divided equally between them.

Following the divorce — during March or April 2013 — they allegedly concluded a verbal agreement under which Reena Maslamoney agreed to lend Dayalin a sum of R100 000.

The alleged terms were that the loan would be interest-free and that he would repay it on demand.

It was allegedly further agreed that Reena would arrange to have the agreement put in writing.

The summons states that on April 5 last year, an employee from Reena’s attorney presented Dayalin Maslamoney with a document to sign.

It is claimed that Reena “falsely” represented to him that the document concerned contained the terms of the (loan) agreement they had concluded, knowing that it was in fact an agreement to transfer his half-share in the Chase Valley property to her.

A copy of the disputed agreement is attached to the court papers.

It states that the parties agree that Reena will pay Dayalin R100 000 of which R50 000 will be paid upon signature of the agreement and R50 000 “upon registration of transfer of the property as mentioned below”.

The documents states the funds will be used to “settle arrears rates and electricity on the property” and the remainder will be used for future rates pending transfer of the property and for expenses relating to Dayalin’s business and personal requirements.

The agreement further stipulates that Dayalin will transfer his half-share in the property to Reena, who will be responsible for costs of the transfer and that he (Dayalin) will be required to vacate the property within a month of the date of transfer.

The agreement also lists the furniture that is to be removed by Dayalin from the property.

The agreement was signed by both Reena and Dayalin on April 5, 2013.

Reena has two weeks from the date when she received the summons, to oppose the application.

Attempts to contact her for comment on the matter yesterday were unsuccessful.

Dayalin Maslamoney made headlines earlier this year when he and a co-accused, Zaheer Khan, were arrested for posing as “bogus policemen” and stealing R250 from the occupants of a house in Boom Street.

That trial is due to begin in the magistrate’s court in Pietermaritzburg on July 7.

Maslamoney told The Witness in an interview soon after his arrest in that case that his lotto winnings were all gone.

However, he denied rumours that he wasted the money on parties, liquor and drugs for his friends.

He said he had given money to various charities and to his church where he established a feeding scheme. Some of the proceeds also went on buying a house in Chase Valley together with his wife for R1,7 million, and he also bought and sold several cars and invested R1 million for his daughter.

He said he and his wife also gave away large sums to their respective family members.

Maslamoney won R10 498 000 on a R50 “quick pick” ticket that his wife bought on his behalf on April 18, 2009, at a Pietermaritzburg garage. At the time he was a member of the SA Police but he resigned after winning the lotto.

Two months later his (now ex) wife, Reena, obtained an interdict in the high court to stop him from spending the money pending the outcome of the divorce action she had intended to institute at the time.

The couple later reconciled for a time prior to their eventual divorce last February.
