MEC accepts HIV damages ruling

THE MEC for Health in KwaZulu-Natal, Dr Sibongiseni Dhlomo, respects the high court judgment that found his department liable for damages suffered by a Gauteng woman who was infected by the Aids virus because of negligence by paramedics at an accident scene.

Dhlomo will study the judgment before deciding on further action, said a statement issued yesterday.

Judge Chiman Patel found in a judgment handed down on Wednesday that it was probable that a pedestrian who was killed in the crash at Mooi River on August 31, 2000, was infected with HIV and that a paramedic had transferred the virus to the woman after handling the pedestrian’s body.
