My mother kept saying she’d been attacked’

2015-02-11 00:00

A BISLEY woman enjoying breakfast at a restaurant in August, 2012, got a distress call from her elderly mother saying she’d been “attacked”.

This evidence was given in the high court yesterday by the woman, who cannot be named in order to protect the identity of her mother who was allegedly raped during the incident.

She gave evidence at the trial of her mother’s alleged assailant, 33-year-old Mduduzi Phenyane of Westgate.

Phenyane has pleaded not guilty before Judge Anton van Zyl to charges of housebreaking with intent to rob and robbery with aggravating circumstances, attempted murder and the rape of the 74-year-old woman.

The alleged attack took place in the victim’s “granny flat” adjoining her daughter’s home in the Bisley area on August 25, 2012.

The state alleges in its indictment that Phenyane had decided to rob individuals in the area some time prior to the attack. On that morning he approached the victim’s property and when an opportunity presented itself, he entered her home.

He accosted the elderly woman in her bedroom and subdued her by “strangling, punching and kicking her”.

He then removed her clothing and raped her.

Afterwards he searched her belongings and took some of her property.

He allegedly threatened to kill her and stabbed her before fleeing the scene.

Yesterday the victim’s daughter said her mother kept uttering on the phone that she had been “attacked”.

She and her husband and young daughter had raced home where they found her mother seated in her chair in her flat. She was bleeding from her head and appeared to have a “mark” in the area of her collar bone.

“It looked as if she had been stabbed,” she said.

“She said she had been attacked and after a while she told us she had been raped. She said that she had been kicked and that he tried to strangle her. She also said that every time she moved he told her he was going to kill her,” the woman testified.

She said her mother seemed “shocked, traumatised”.

After paramedics “calmed” her, she was taken to hospital by ambulance. She was admitted “for a couple of days”.

The woman identified a sewing machine in court as one of the items stolen by the assailant.

He also took her mother’s Samsung cellphone, a wallet and a bag, she said.

The case is continuing.
