Not guilty plea in road rage murder

Mthembu is charged with shooting dead Derrick Majozi (29) near Mason's Mill on the Edendale Road on April 9, 2006.

The state alleges that Majozi - an Imbali taxi operator - and Mthembu initially had an altercation at about midday on the day. The accused allegedly then planned to kill Majozi and armed himself with his licensed gun.

That evening at about 6 pm, while Majozi was driving along Edendale Road, Mthembu allegedly stopped his vehicle in front of Majozi's taxi and both men alighted. During a subsequent confrontation Majozi was killed.

Hlengiwe Ngcobo, Majozi's common-law wife and mother of his child, who witnessed the shooting, told Judge Chris Nicholson that after stopping the taxi, Mthembu approached and demanded an apology from Majozi “for what you did at about midday”.

When Majozi responded by saying “What are you after?”, Mthembu produced his gun.

Ngcobo screamed and Majozi tried to grab the firearm, but Mthembu punched him and he fell on to the grass verge. During an ensuing struggle, numerous shots were fired one after the other, she said.

She said Mthembu dragged Majozi in front of the taxi, saying he was “teaching him a lesson” before getting back in his vehicle and driving off. Majozi died at the scene.

She said Majozi did not have a weapon.

She disputed Mthembu's version that Majozi was the aggressor, and was armed with a knife.

The court was told Mthembu will testify that he was “back pedalling” and tried to flee from Majozi.
