Outcome of Constitutional Court appeal won’t affect Mangaung

THE ANC’s elective conference in Mangaung will not be affected by the outcome of the appeal made to the Constitutional Court by six members from the Free State, ANC national spokesperson Keith Khoza said yesterday.

This was after the Constitutional Court granted disgruntled Free State ANC members leave to appeal the validity of the election of their provincial executive committee. The matter has now been set to be heard in the Constitutional Court next week.

The ANC has until November 26 to file their opposing affidavits, and the applicants their replying affidavits by the next day.

The six initially asked the Free State high court to declare null and void the provincial elective conference (PEC) held in June.

They also wanted the court to order the national ANC to dissolve the Free State PEC, appoint an interim management structure and annul the province’s nominations for the Mangaung conference.

When the high court dismissed their application for leave to appeal, they took the matter to the Constitutional Court.

Khoza said that regardless of the ultimate outcome of the appeal, the Mangaung conference won’t be affected even if the court gave an order to disband the PEC and annul the Free State nominations for leadership.
