Pair used toy guns in rape and robbery

TWO men were found guilty on Friday of robbing two people at Maphumulo using toy guns and of taking part in the gang rape of an 18-year-old woman.

Sifiso Malunga (21) and Siyabonga Mathebula (25) of Nyamazane area at Maphumulo pleaded guilty to charges of housebreaking with intent to rob and robbery with aggravating circumstances, and to three counts of rape each.

The crimes took place on August 25, 2010, in the Danyini area of Maphumulo.

In statements read to acting Judge Madlala Xolo by their legal aid attorney, Kelvin Singh, the men said they and an accomplice, Lungani Ngiba, had decided to break into the victims’ home on the night in question to steal goods.

Malunga said he and Ngiba kicked the door of the house open and entered the house armed with toy firearms, while Mathebula remained outside the house.

He and Ngiba held up the two occupants of the house with the toy guns, took a DVD player and hi-fi system and left, taking the young woman with them.

Both accused admitted that they and their accomplice had each raped the woman at a half-built kraal nearby, before fleeing the scene.

The case was postponed until today at the request of state advocate Rose Sepeng, who said the prosecution wanted to establish whether the accused have previous convictions.
