Pinetown advocate struck off

PINETOWN advocate Edwin Levin, accused of flouting the rules of the profession, was removed from the roll of advocates by consent in the high court in Pietermaritzburg yesterday. The KZN Society of Advocates had applied to the high court to strike Levin off the roll for his alleged transgressions. He opposed the application, which was set down for oral evidence to be led yesterday.

Both parties consented to an order that Levin’s name be removed from the roll on condition he undertook not to practice as an advocate or apply to any South African court for re-admission as an advocate or attorney.

He was ordered to pay costs.

The chairperson of the KZN Society of Advocates, Marumo Moerane, alleged in court papers bythat Levin had flouted the profession’s rules “in a litany of instances”.

Levin had dealt directly with members of the public, appeared as an advocate in the absence of an instructing attorney, and performed the work ordinarily done by an attorney. He was also allegedly paid fees directly by members of the public, and was alleged to have misled a court during legal submissions. Moerane said Levin had been suspended previously (in January 2002) for the same conduct but had ignored his suspension.
