Post: Vryheid manager goes to court

A PIETERMARITZBURG high court judge has reserved judgment in an application seeking to enforce the appointment of a new municipal manager to Abaqulusi (Vryheid) Municipality amidst allegations that the “preferred candidate” provided false information in his curriculum vitae (CV).

The Inkatha Freedom Party and Dr Vusumuzi J. Mthembu — who was allegedly voted in as the new municipal manager in terms of a council resolution taken on December 4 last year and again on March 5 this year — wants the court to order Abaqulusi mayor P.N. Khaba and the council’s executive committee, to implement Mthembu’s appointment.

The post of municipal manager in the municipality has been vacant since July 1 last year.

The application is being opposed by, among others, the MEC for Co-operative Governance and Traditional Affairs in KZN, Nomusa Dube.

In court papers, acting senior manager

Lionel Pienaar says the MEC raised concern over Mthembu’s appointment after it transpired that Mthembu was not an employee of the University of KZN as he’d claimed in his CV. In light of the allegedly false information supplied by him, his appointment would be illegal in terms of the municipality’s own policies.

Pienaar said he conveyed the MEC’s concerns to the council, which was supposed to consider the issue and report back to the MEC but failed to do so.

It appeared that the appointment was “rammed through” (by a majority vote of 22 to 18 councillors) despite its illegality.

IFP councillor Mbongeni Sibiya says in his affidavit that he and others believe that Mthembu’s appointment was being delayed on “ulterior political grounds”.
