Prison for dad, 3 sons

FAMILY members sobbed in court on Friday when Govindsamy Moodley (50) and his three sons, Roland (28), Damien (20) and Darrol (24), were led away to spend Christmas and New Year in jail.

The four were found guilty of attempting to murder Pietermaritzburg attorney Nasen Naicker after luring him to their home in Bangalore Road on December 26, 2011.

Only Damien Moodley — who was 17 years old when the incident happened — escaped a jail term.

However, he remains in custody in another case where he, his father and brother Darrol, are charged with intimidating Naicker.

That matter is only due back in court again on January 9.

Regional court magistrate Verushka Jamuna sentenced Govindsamy Moodley to six years in jail for the attempted murder of Naicker, while Roland and Darrol were sentenced to five years’ imprisonment each.

Damien was given a wholly suspended sentence of four years’ imprisonment.

Jamuna told Govindsamy Moodley he deserved a “robust” sentence because he used a bush knife — which is an extremely dangerous weapon — to attack Naicker. He had struck him on his head with the instrument.

She said he also influenced his sons to become involved in the attack. “Your actions were totally reprehensible,” she told him.

Jamuna said none of the four accused showed any remorse. In the case of Damien, a probation officer reported that he did not accept responsibility and “saw nothing wrong” in his actions.

Jamuna said the regional courts are dealing with an “alarming” increase currently in serious and violent crimes committed by juveniles.

The four men were found to have deliberately planned to assault Naicker because they wanted revenge in respect of an altercation that occurred the previous day involving Roland Moodley.

They lured him to their house by pretending that they wanted to hire him to represent one of them in a drunk driving matter.

When he was seated in the lounge they set upon him unexpectedly “chopping” him on his face and ear with a bush knife. He was also stabbed in his chest with a knife by Damien, and hit with sticks.

Medical evidence confirmed that five of the injuries Naicker suffered could have been fatal.
