RAF: Victim claims R16?mln

KIM McCusker, the young Johannesburg advocate who was dragged 700 ­metres under a taxi in 2011, described the extreme pain she endures every day, ­during a claim against the Road Accident Fund (RAF) for R16 million.

McCusker (29), who will probably never be able to practise as an advocate again, painted a dark picture of her life. She is likely to need a knee replacement before she is 50, will not be able to give birth normally, and is on pain medication that might threaten a pregnancy. She cannot sit for long periods, which means she can’t drive, and cannot walk far.

She needs long-term rehabilitation and plastic surgery for injuries that the RAF’s medical consultants described as “grotesque”.

The RAF has already paid out R3 million for medical costs following the ­incident in which she was run over by a taxi following a road rage altercation between her then fiancé (now husband) Lourens Grobler and taxi driver Matome Thamage.

McCusker testified that she clung beneath the taxi for dear life, holding her head up so it wouldn’t bounce along the tarmac. In places, her flesh was scraped from her body down to the bone. She endured months in hospital and several operations.

Advocate Sash Nankan, for the RAF, asked McCusker if she really suffers as much as she alleges, pointing out that she goes to gym, was able to sit in court and helped compile the detailed court papers in the case. She replied that the gym exercises are intended to help her regain movement and in the hope that they will help her manage the pain.
