Rape: DNA tests clear man of attack

CHARGES were yesterday withdrawn against a 28-year-old man charged with raping a 94-year-old woman in her home at kwaSwayimane near Wartburg after DNA tests showed that he was not the assailant.

The rape charge was formally withdrawn against Ntuthuko Ndlela in the New Hanover Magistrate’s Court yesterday, but he is still facing a charge of robbery relating to another incident.

The case against Ndlela was based largely on the identification by the victim’s young grandchild who witnessed the rape, but DNA tests, which only recently became available, show that the child was mistaken.

This was confirmed yesterday by police spokesperson Lieutenant Joey Jeevan.

The rape case has received widespread publicity in the press and on television and the local community expressed outrage at the attack on such an elderly woman.

In evidence at his bail application in August, Ndlela denied he was responsible for the rape of the woman on July 21, as well as an allegation that he assaulted and robbed a 46-year-old woman of her cellphone on July 10. He is awaiting trial on the latter charge.
