Rape trial: teen released into guardian's care

A 14-YEAR-OLD boy who is among three teenagers charged with the gang rape and murder of a 14-year-old girl in Mountain Rise cemetery on July 30 last year was yesterday released into the custody of his guardian.

Pietermaritzburg magistrate Reard Abrahams said he took into account that the prosecution had withdrawn its opposition to bail being granted to the youngster, the fact that his guardian had attended every one of his court appearances to date and that he was still at school.

The state remains opposed to the release of the youth’s older co-accused (aged 17 and 20) on bail, and their bail application was postponed to March 1.

The trio are charged with the gang rape and murder of Mabongile Xaba and of stealing her cellphone on the day in question.

The 17-year-old faces two additional charges of murder and robbery arising from an incident in which a man, identified only as “Rasta” on the charge sheet, was stabbed to death and robbed of his cellphone in Balhambra Way on November 5.
