Struggle with victim ‘aroused’ teen rapist

A 17-YEAR-OLD youth has pleaded guilty to rape and robbery with aggravating circumstances of a 64-year-old woman at Rosetta in the KwaZulu-Natal midlands on December 5 last year.

Judge Trevor Gorven will hear submissions concerning a suitable sentence to be imposed on the accused from state advocate Candy Kander and legal aid defence attorney Ishi Khan on April 14.

In a statement read to the court yesterday, the youth said he had gone to the victim’s home on the day in question to look for a job.

“When I entered the complainant’s yard I saw her hanging clothes and I also noticed that the kitchen door was open … I perceived this as an opportunity to rob the complainant. I entered the complainant’s kitchen without attracting her notice, where I waited for her to return.”

The youth said the woman entered the kitchen and locked the security gate behind her. As she did so he confronted her and demanded money.

“In addition to binding her hands with a cloth that I had found in the kitchen, I slapped the complainant several times and I throttled her while I continued demanding money from her,” he said.

The woman took him to her bedroom and gave him R680 from her bedside drawer, and he took a jewellery box from her dressing table.

He said he and the woman continued to “grapple” with one another and he had eventually subdued her by pinning her to the ground.

He said during the struggle he became “aroused”, pulled down the victim’s trousers and underwear and sexually assaulted her.

“I heard a noise outside and … I fled from the scene,” he said.

According to a medical report the victim sustained bruises to her face, neck and shoulder. The doctor also found evidence of a sexual assault.
