Taxi driver ‘was more aggressive’

Both vehicles stopped and the drivers alighted. “The taxi driver, instead of apologising, alighted from his vehicle and wanted to fight,” Ndlovu said.

Ndlovu said because he was seated on the passenger side and was the person who “almost got hurt”, he was very angry and felt that he wanted to hit the taxi driver.

He said Mthembu, however, led him back to the car and they drove off.

Before that, Mthembu simply told the taxi driver that he should “go and get a licence because that is not the way to drive”.

Ndlovu said he did not realise that Mthembu in fact was armed with a firearm. This only came to his attention when they entered a store and Mthembu was asked about the gun by store security.

Mthembu is charged with having confronted Majozi again several hours later and shot him dead during a second altercation near Mason’s Mill on the Edendale Road.

The state alleges the shooting was premeditated, but Mthembu’s counsel Aron Perumal urged Judge Chris Nicholson yesterday to find that this was not the case.

Mthembu testified that the shooting happened “by mistake” while he was defending himself against Majozi, who allegedly attacked him with a knife.

Judgment will be given today.
