Teen rape accused to plead guilty

A RICHARDS BAY teenager accused of raping and assaulting a 13-year-old girl at a drunken house party and filming the incident on a cellphone is expected to plead guilty at Esikhawini court today.

The minor, known as Accused 2, along with one other minor (Accused 1), allegedly sexually assaulted and raped the unconscious teen while filming the entire ordeal on a cellphone and sending the video to schoolfriends.

It is alleged they violated her with a mop handle, and sand and lemon juice.

A third minor accused has turned state witness.

The incident happened at a house party in the Brackenham suburb during school hours in March 2011, which was attended by five teenage boys, one 20-year-old man and two teenage girls. Initially the state charged all six males but eventually dropped charges against two of them.

Yesterday was to mark the start of the two-day trial against the minors; however, due to Accused 2 entering a guilty plea it has been rolled over until today for a statement to be prepared and read out in court.

According to court sources, if he does not implicate Accused 1 the trial will continue at Esikhawini court, but if he does implicate the other minor, the trial will need to be separated.

In April 2012, Sheldon Sathianathan, then 20 years old, admitted to having consensual sex with the high school girl at the party.

He was handed a six-year sentence, wholly suspended, and three years’ correctional supervision.

He was also given 16 hours’ community service each month for the duration of the correctional supervision.

In Sathianathan’s plea agreement he gave a graphic account of exactly how the two came to have sex, painting a picture of large amounts of alcohol being consumed.

The victim did not give testimony in court and therefore the claim of consensual sex by Sathianathan could not be challenged. He claimed he was not present when the minors repeatedly violated the 13-year-old schoolgirl from Richards Bay Secondary School.

The schoolgirl was later found by a teacher near the school grounds with her body and clothes covered in blood.

The other girl who attended the same party sustained no serious injuries, but was allegedly so drunk she could barely walk.
