Witness lied, rules judge

KWAZULU-NATAL Deputy Judge President Herbert Msimang has ruled that a state witness lied when he claimed he was induced to give false evidence in the murder trial of Howick married couple Sanesh Manilall and Mumtaz Osman.

Manilall, Osman, and Mbongiseni Victor Mbatha are charged with the murder of Manilall’s late wife, Monika, who was shot dead in her home by intruders in 2006.

Msimang ruled at the end of a trial within a trial on Friday that the alleged gunman, Siyabonga Mdlalose, was not telling the truth when he alleged that state advocate Dalene Barnard and Inspector Swami Pillay of the organised crime unit promised to reduce the life sentence he is currently serving for the murder to one of 20 years’ imprisonment in exchange for his testimony in the case.

Mdlalose is serving a life sentence for the murder of Monika Manilall to which he pleaded guilty.

In May this year, he gave evidence for the state in the case when he implicated Manilall, Osman and Mbatha in the murder, but then changed his version and claimed he knew nothing about the offence and had repeated a version that was given to him by the police.

The case is proceeding.
