Editorial: Guptas live and lead

ANC Lives. ANC Leads. This was one of the party’s mantras in a bygone era, when the ANC took a decision as a party and its cadres implemented.

Today the Guptas Live and the Guptas Lead.

In its post-national executive committee (NEC) meeting statement on Monday, the ANC said it had agreed to the urgent establishment of a judicial commission of inquiry into allegations of state capture. But it added that the terms must be broad enough to uncover the influence of business on the state since 1994. The NEC expressed its desire to see all processes of reviewing the Public Protector’s State of Capture report accelerated so that they are not an obstacle to the commission’s start.

The ANC followed this up with a statement on Friday that “noted with grave concern” the revelations emanating from the #GuptaEmails scandal and reiterated the call for a commission.

Well, there lies the crux of whether the ANC leads and the ANC governs. With this decision, those deployed in government are called to act on the report of the Public Protector. President Jacob Zuma should therefore heed his party’s call and appoint the commission. The criminal justice cluster must use the report to bring people who may have committed crimes to justice. Those who used their political office and state employ to serve private and foreign interests in exchange for gratification must also face the wrath of State Security Minister David Mahlobo. He must forget about the West for now. The enemy could be much closer, Minister.

The ANC should not conflate issues by wanting the inquiry broadened. The Public Protector’s report dealt with a specific matter concerning the Gupta family, following complaints lodged with the office. The Public Protector’s remedial action should be adhered to without any alteration, as the Constitutional Court confirmed in the Nkandla judgment. Tampering with it would be tantamount to contempt not only of the Public Protector but of the Constitutional Court. It is also nothing but a red herring. Such an inquiry could go on for years and probably not produce any tangible results.

South Africa and the ANC must not allow Zuma, the Guptas and their filthy crew to divert us from the search for the truth and the dismantling of the criminal syndicate they are running.
