'ANC respects judiciary'

by Chegoane Mabelane
2009-07-08 12:17

Dear Editor,

In the ANC we respect the judiciary's independence. However, respecting does not imply we shouldn't criticise if there is a need.

People should not portray the distorted image that it is only in ANC where the judiciary is not beyond criticism.

People want to live in democratic society without applying the principle of democracy. Clearly democracy allow us to criticise if need be.

As ANC-led government we believe that the transformation needs to be catalysed within the institution.

The malicious statement by the Democratic Alliance that the transformation is a smokescreen for creating a bench that will serve the ruling party's agenda is irrelevant and typically oppositional to change.

Their leader who is forever surrounded by negative energy when she speaks went further to say about 55% of judges were black which is the indication that the racial diversification of the judiciary was on track. In a country of more than 88% of blacks, the 55% indicate a slow progress of transformation over the years hence the agenda needs to be pushed harder than ever before.

Mabelane, the Constitution, which the ANC took part in drafting, states in section 165(3) that "no person or organ of state may interfere with the functioning of the courts." When the ANC's hoodlums call judges "counter-revolutionary", claim thru their leader JZ that judges are not Gods, COSATU threatened that unless the charges against JZ were dropped there would be blood on the floor, does that show any respect for the judiciary as you claim? For ANC sheep it does not matter what really happens, as long as their leaders say it was not happening, their words speak louder than their actions right? Please go preach to other ANC sheep and keep maintaining the lie. Everyone who can think independently, and who is not ANC sheep or parrot, knows that the ANC has so much disdain and contempt for the judiciary. Their actions, not what they say, is enough evidence

Alien Dude 7/8/2009 12:39:36 PM
Thx for the laugh.....what a load of crap.

oral @ Shimane Mbuyisa 7/8/2009 12:43:07 PM
Well said, The ANC's typical response to everything is we Respect this and that but but but actions speak louder than words and until we see the ANC leaving the judiciary alone we cannot believe a word they say. To respect the judiciary and in the same breath threaten its very existance is pathetic and the truth is I dont believe the ANC at this very moment respect much unless people threaten with millitant action or it effects their pockets.

Ivan@author 7/8/2009 12:44:09 PM
"In a country of more than 88% blacks", You are right, but the problem going forward is ensuring a bench that WILL actually prosecute the ANC criminal like Mbeki and Zuma etc. Surely that is more important than just a black majority on the bench? Hell it was a white judge that set the scene for that thief JZ to be "freed", so what are you ANC'ers complaing about/

bob 7/8/2009 12:46:09 PM
hahahaha....funny stuff

@Stinker 7/8/2009 12:51:14 PM
Ok fine. I will leave this country if you want me to. Just remember I am taking my R100 000 tax money p/a with me.

Cynical 7/8/2009 12:52:09 PM
Thanks Chegoane (btw what does "Chegoane" mean? Oh OK, I know, it means "genius", right?). You must have an IQ of at least 3000 to to have written such a brilliant masterpiece. Yes let's transform the judiciary with speed - I suggest we appoint people like Polidonkey and Cape Town Juvenile as judges without delay. Thanks again for a great read.

Strijdom 7/8/2009 12:53:02 PM
In the 1950's the Nats appointed judges to further the government's political aims. Why would and could the ANC not do the same?

@Stinker 7/8/2009 12:55:39 PM
We ain't going anywhere buddy, and you sound like the one who is crying???

Oral @ Bongani 7/8/2009 12:55:54 PM
You 100% right, what kind of idiots would actual think that would change things......makes me laugh! Like every person with a lttle bit of intelligence should know by now that nothing can change Africa except black people and we know thats going take around 500years. LOL

Tumelo 7/8/2009 1:01:34 PM
If the world believed national media and it was found to be accurate on portraying the ANC as anti-judiciary we could be by now witnessing it. The ANC and its leaders were shown as lady justice's rapists, against everything that justice stands for and a mob that is fighting law. What we currently see though is different. A goverment that upholds the rule of law, in consultation with judiciary officers and in unequivocally is suport of law and order. The new law enforcement agency;Hawks, just launched three days ago have scored their first success already. We is South Africa are confident that the law and all its apparatus is in safe hands with the ANC goverment.

WILDFIRE 7/8/2009 1:01:53 PM
The ANC does not even respect the lives of its citizens on farms - nevermind the judiciary - re Shaik , Zuma. In fact the ANC is a totally useless party. What have they achieved except telling lies and steling from the taxpayer ?Useless bunch of no good plonkers - same as the Poliodonkey and his pathetic tjommies.

SimonP 7/8/2009 1:03:18 PM
Anyone who believes the ruling party have not, and will not, interfere with the judiciary is completely insane. The NPA dropped the charges on JZ without any interference - I think not. If Hlophe is promoted it will prove the ANC do not believe in an independent judiciary.

WILDFIRE@Shimane Mbuyisa 7/8/2009 1:06:38 PM
Never a truer word spoken - very good to see your response to this pathetic article.

Sean 7/8/2009 1:24:36 PM
@Tumelo, surely the arrest which the Hawks made should have been carried out by the SAPS? The ANC has no respect for the judiciary at all. One just has to look at the whole Shaik saga. Here is a person in prison (well for a whole 2 months) for fraud and corruption. Yet they get off because they are "terminally" ill. I have it on good terms that is indeed that this is not the case. Even the ambulance arriving at his house was a show put on for the media.

SimonP 7/8/2009 1:32:22 PM
@Tumelo, what evidence have you SEEN? I believe what you meant to say was HEARD. The ANC tell you what they are doing and you believe it, whereas in reality their actions contradict what they say.

Ed 7/8/2009 1:34:28 PM
Chegoane- you're just making a fool of yourself. What a load of nonsense. Please read Shimane's comment (SPOT ON)!I you want to talk about respect, why don't you really practice it? For the ANC has NO respect for any opposition party. For they have the right to "criticise where there is a need", to quote your own words. Stop pretending and get off your high horses (and fat asses) and bring the change to SA that your are so proudly promissing. Useless...

fuzzy 7/8/2009 1:34:31 PM
If teh judgement goes agaisnt them then the judges are counter revolutionary. When they win then justice has prevailed. makes sense to me! Added to this lack of respect is the desire to transform the numbers. A judge should be a learned man with years of legal experience. Somehow i dont see them in our ethnic legal fraternity. By the way, Hlope was, is and forever will be a plonker.

IandI 7/8/2009 1:34:55 PM
Which ANC are you representing? Judges who rule against the ruling party are apartheid-era counter-revolutionaries...you should know that if you belong to our beloved ANC.I suspect you are a COPE mole, Chegoane!ANC members know a counter-revolutionary judge when they see one.

SimonP 7/8/2009 1:48:34 PM
@Tumelo again,"If the world believed national media and it was found to be accurate on portraying the ANC as anti-judiciary we could be by now witnessing it" Wake up, The world does believe the media because it is accurate. You witnessed charges against JZ being dropped, you witnessed Shaik being let off under false pretences. It is only idiots like you that refuse to see what is really happening. What have you witnessed to the contrary?

Poloyatonki 7/8/2009 1:53:52 PM
The problem with most of you guys is that, you know that your parties will never rule this country. Now, the only thing that you can do is being negative. COPE is now breaking apart piece by piece as expected. DA has never said any thing since election, I live here in Cape Town, but I haven’t heard anything from them. I was in Summer Greens on Monday evening at a very productive ANC meeting.

Mark V 7/8/2009 1:59:09 PM
Yes landl, typical - the love for the party weighs more than justice. Somehow that comes as no surprise.

Mark V @ Polyatonki 7/8/2009 2:02:38 PM
Maybe, just maybe ACTION speaks louder than words...

Jann 7/8/2009 2:04:34 PM
When did this respects for the judiciary start? Oh, I know. Right after Shaik was released and the charges against Zuma dropped.

Lucky Ralawe to Poloyatonki 7/8/2009 2:05:23 PM
Can we debate the issue raised by the other ANC sheep Mabelane and not change the subject? He lied through his teeth, or deliberately tried to pass the ANC progapanda without having tested it himself. Now he is silent, or will try and change the subject like you his fellow sheep. Besides, the ANC's recent election results were the worst in its history, which to me says the ANC is on the decline. I know because I took away my vote from them, and also made sure those I knew voted against them. They will never see a two-thirds majority again, and that is if we don't boot them out at the next election.

mhingeni 7/8/2009 2:07:34 PM
The there is an urgent need for the new administration(ANC) to speed up transformation in the judiciary. This is not negotiable. We know for the fact that the judiciary is dominated by racist white judges.I know I will be crusified for saying this.I am more than happy to give examples immediately when I receive a dissenting view. However, transforming the judiciary does not necessarily mean that judicial positions be filled with incompetent black legal professionals. There are more than enough, well qualified and competent black professionals who are deserving to take more than 95% of the judicial positions to ensure a true transformation of the judiciary.

ARYAN 7/8/2009 2:08:41 PM
The Commies are in full force on this webpage again.I see if they cant get a 2/3 majority to change the constitution they just replace the judiciary with their Commie buddies and therefore whipe the constitution off the map anyway. That peace of crap that was negotiated 15 years back is not worth the paper it is written on and is used by the ANC as a measure of how not to conduct themselves.FW and his buddies must really be pissed as their little dream is slowly falling apart. This country is becoming a bigger joke everyday. (and no I wont be leaving but will be in the frontline when the sh@t hits the fan)

Kenroid 7/8/2009 2:09:58 PM
55% Black judges in 16 years...and you say that it is SLOW?!?! Have you any idea what is required to become a judge? Do you think that someone who has just finished law school would be competent enough to serve on the judiciary? This position requires a little something called EXPERIENCE!!!

T 7/8/2009 2:14:21 PM
What a laugh, thank Mr Author. No need for office funnies today. Btw, your statement "The malicious statement by the Democratic Alliance that the transformation is a smokescreen for creating a bench that will serve the ruling party's agenda is irrelevant and typically oppositional to change" could this be another smoke-screen??????

Steve 7/8/2009 2:29:58 PM
It's a pity the ANC's 'respect' for the judiciary only shows when one of its elite is let off the hook...again.

LM 7/8/2009 2:33:34 PM
Please! Cheeky my boy, the anc don't know how to spell respect. Just look at how poliodonkey (Senyobatonki)and his anc troop disrespect their superiors...

WILDFIRE@Poliodonkey 7/8/2009 2:39:42 PM
"a very productive ANC meeting" - what did you do - produce shit again ? Get out of the Western Cape you plonker - we have no use for the rear end of a donkey here.

Poloyatonki 7/8/2009 2:46:00 PM
Lucky Ralawe - one thing is certain, most of the things that you achieved today its because of ANC....in the past you never had rights, and you are a free to make your dreams come true. Pardon me if i am wrong..

Mark V @ Polyatoki 7/8/2009 2:56:19 PM
Although they played a role, they were not solely responsile for the demise of apartheid. You are excused.

Gonzo101 7/8/2009 3:07:33 PM
Shimane Mbuyisa you legend

Fat Elvis 7/8/2009 3:12:49 PM
man you say one thing and do another.

Lucky Ralawe to Poloyatonki 7/8/2009 3:34:00 PM
You are right. But that does not mean that I owe my loyalty to the ANC if I can clearly see that they are taking my country down towards anarchy and lawlessness. Tell the same truth to a Zimbabwean who was liberated by Mugabe's Zanu PF. I want a good, ethical and clean government. If the ANC cannot offer me that, I am not going to follow them down the cliff like some ANC sheep that I know. Let them return to the good ANC that I knew and voted for in the past, and perhaps I may just renew my membership. Until then, I will vote against them, and make sure that when my son young children reach voting age they also vote against them. By the way, I was also part of the ANC and did my bit to liberate the country too. I have nothing that I did not fight for and deserve, and unlike most ANC sheep who vote for social grants not knowing that this is constitutional imperative, any government can take over and nothing will change for the worse for me because I don't depend on handouts.

Shimane Mbuyisa to Gonzo 7/8/2009 3:35:09 PM
Eita daar Gonzo 101 eita!

CTheB 7/8/2009 3:48:51 PM
Yes, Poloyatonki, keep telling yourself the lie that it was the ANC and no one else that ended apartheid, that no one else had anything to do with it.

Oupa 7/8/2009 4:14:38 PM
Stinker you say you want to take your R100 000 per annum of tax and leave the country?. I simple advice for you is that take it and leave us in peace. Any of you who want to leave please do so without delay. South Africa will continue to prosper without you. In case you don't believe me, ask your brother who also left

Oupa 7/8/2009 4:22:21 PM
Majority of whites commenting have a selective memory. During apartheid you couldn't comment like this about the ruling party (NP). Now that we the ANC have given the freedom of speech you abuse it.We have done you a favour by not reversing apartheid. Stop being idiotic

SimonP 7/8/2009 5:18:15 PM
@Oupa "South Africa will continue to prosper" This is the whole misconception we see day in day out from you ANCers telling anyone who is unhappy to leave. FACT: SOUTH AFRICA IS NOT PROSPERING. What makes you think it is? Did the ANC tell you it is? Simple look at the facts, health care, crime, unemployment show me where SA is propering.

SM 7/8/2009 6:29:27 PM
@mhingeni. You insist that the quota be filed in the judiciary. What about having expereinced, impartial and lawful judges. That is irrespective of colour, that can give a true service to a democratic counry. I am all for a all black team, IF they are the best there is and not because they are black. Unlike racist people the typical educated person does not care about colour but about service, the best that can be achieved. Take the chip off your shoulder and strive for the best for ALL and not just the 66% people who voted ANC.

Eles 7/9/2009 7:00:40 AM
All I have to say is that a) you talk such drivel why don't you just apply for a government position already! 2) if our gov had as much passion and efficiency as that woman you refer to they would be far more productive and even I would vote for them. 3) Our leadership has no balls when are they going to stand up to Zim, up to the taxi bosses, stand up to AU etc. I am not impressed at all.

Nats@Lucky Ralawe and Shimane 7/9/2009 8:10:43 AM
You rock! Thanks for saying it like it is.

Sinudeity @mhingeni 7/9/2009 8:12:57 AM
There are more black judges than white judges, currently. Check your facts before you spew lies.

Sinudeity @Poloyatonki 7/9/2009 8:30:44 AM
Yeah polo. Show us, that you are SERIOUS about transformation. Lets get some more transformation in Bafana. Lets get transformation going in Lithuli house. Transformation DOES NOT MEAN 100% BLACK.

DHV 7/9/2009 9:25:47 AM
Well said to Lucky and Shimane. We all need to take responsibilty for our OWN actions.

KzN 7/9/2009 9:30:21 AM
The Shabir Sheik / Zuma saga as well as the Judge Hlophe, Yengeni, McBride etc cases make these statments laughable. The courts are just another tool the ANC use to dominate and ultimatley steal teh wealth of the country. The poor will remain poor.

@ Oupa 7/9/2009 10:21:39 AM
You are so quick to tell people to leave. If I and 10 of my buddies leave there is already a R1m loss for this country to support the poor with (and by Merc etc). Go ask your brother who lives in a shack and whos kids education I am paying for if he want's me to leave!

@ Oupa 7/9/2009 10:26:23 AM
Just remember...its hurts SA more to lose an actual taxpayer as we all know there is not many of us. Don't cut of your nose to spite your face and actually chase the people that contribute away.

samsam @KZN 7/9/2009 10:51:32 AM
you forgot to mention Dr Wouter Bousson, Adriaan Vlok

SM 7/9/2009 11:14:15 AM
@samsam: We did not forget them, they actually WENT to trail and were found innocent. There comes cases to mind that has NOT been in court YET. Probably wont either as there is no facing justice for the elite anc.

Sinudeity @samsam 7/9/2009 11:44:19 AM
With regards to basson and vlok, you should also, take into account, for apartheid atrocities, JZ himself, for killing his fellow South Africans in Angola, suspected of being spies. JZ = red ant

Shiza T 7/9/2009 11:48:02 AM
Please someone define 'Transformation'(as its used so liberally) , from what to what ? . If it purely based on color then we find ourselves in a bit of a hipocracy AGAIN. Then there is the seperation of the state and judiciary which apparently means nothing to the ANC... go figure how they can then say they respect the judiciary.

Terry@samsam@kzn 7/9/2009 11:53:24 AM
That makes it ok ? or are using them as examples of state interference in the Judiciary ? Because there a lot of names that could be brought up .
