'Beware the rental agencies'

As a greatly disgruntled tenant I'd like to share my experiences so that others might learn from my "mistakes".

One of the reasons I chose to go with an agency was because I thought we would be getting professional service.  Peace of mind! 

I've heard of people experiencing problems with maintenance of property and so on when dealing directly with the owner's so I thought by going to an agency, especially one that just does letting, that I would get professional service and advice with their specialised consultants.

But my experience with the agency was far from that. 

I've had problems from the beginning. First, the house that we agreed upon, was suddenly unavailable about five days before the move but they had another identical one in the complex.

Of course, as I was in another province I couldn't inspect it, but I was assured that everything was fine.

House not ready

But everything was not fine. In fact, we had to delay movers by a day because the house wasn't ready. I'm not quite sure if it had passed inspection.

Many defects, which I listed and sent to the agency. I gave them a week to fix the important major problems. It was only about 2-3 weeks later that those started getting fixed.  Not even to a satisfactory condition.

More calls to the agency, the "professionals" who can't ensure the landlord does his part.

Their advice: To leave if the property was not maintained. As it contravenes the Rental Housing Act, this supercedes the lease and hence no penalties incurred.

The result: Telling us we breached the lease and hence liable for the remaining months rent, breach of lease fee, commission and so on, amounting to R25 000 approx.

What to do?

The question is, what should I have done? I'm still not sure about the answer despite my research. 

They maintain that although the landlord is responsible for fixing the issues, he can do so at any time as there is no specific time period in the lease.

The advice on the various websites is not to move out, but to contact the Rental Housing Tribunal. However, if you feel your safety is threatened - such as the front door not locking properly so anyone can just waltz in - what do you do?

You can't really wait one month if they refuse to fix it?

Are you within your rights I wonder? 

Of course, the agency decides that a non-working front door is not necessary to fix. Or if it is, they can fix it at any time?

Taking advantage

Rental Agencies take advantage of people's innocent nature. When reading the lease, and as you are dealing with supposedly professionals, who have branches everywhere, who will give you peace of mind, how many of us really expect a problem? How many of us really delve into the nitty gritty?

And even if we do, if the 'trusted' agent says to you, "Don't worry, we'll sort it out", or "Don't worry, you can do it then just deduct it from the rent", how many of us take them at face value?

Do they really expect us to get everything we say with the agent or the agent says to us in "writing"? 

And even if the agent lies to you, there is still the EAAB (Estate Agency Affairs Board), who is in place to ensure there is no misconduct and unfair practice at registered agencies.

But after two weeks they still haven't responded to my email so I'm not sure if they will be all that helpful.

So what were my mistakes? Not asking for EVERYTHING in writing - again I question the practicality of this. Not foreseeing the problems with the lease - though one things the Rental Housing Act will protect you from unscrupulous entities, this is not the case, and also I didn't have a crystal ball to foresee such problems.

Advice needed

The one good thing I did was keep all e-mails and documents I've sent them. I'm currently putting together a complaint for the Rental Tribunal. Hopefully they will make sure that this agency that purposefully doesn't maintain the property will be harshly dealt with, so that others might treat their renters more fairly.

Strangely enough though, the agency that I am currently using, and they do not just do letting, are a pleasure to deal with. Any questions/issues e-mailed to her are responded to by the next day. Minor issues are fixed within seven days. Luckily no major issues yet (touch wood).

If any of you have advice or suggestions, please let me know. Hellopeter unfortunately says that this particular agency does not care to respond. There are a number of complaints lodged against its various branches there.

The BEST thing you could have done now is to PUBLISH the name of the rental agency in THIS letter! - 1000's of news24 users will read it, so I will hit the agency where it hurts!

I'm experiencing similar problems at my current flat in Cape Town. The Agency is incredibly slack when it comes to maintainence, checks, visits etc. They sit on their laurels collecting money while the owner either is completely ignorant of the state of his/her property or in full knowledge that it is getting run down due to neglect on their part. As a tenant you can do only so much, and I'm not prepared to pay the money on the chance that the agency/owner will reinburse me. They should sort it out and IF it is my fault I will pay gladly.

Get a lawyer rather than trying to deal with it yourself. You signed a legal document you now need a legal professional.

@Volric-Good topic.I took occupation in a flat and nobody inspected the flat in my presence for any defects so that when i leave no one will say "this was not there before you came in".I wrote them an email asking when are they going to inspect the flat and i was told the person will come. I decided to inspect the flat myself and wrote everything down,even some small fly sh** on the wall and emailed it to them,printed the email and filed it.They came flying to inspect the flat and fixed it up.

There's nothing as important as filing all correspondence between the lessee and lessor because this is where they try to catch you on when they want to skru you on your deposit.

I agree on the comments about your agent. However I am a landlord and have the same problem with not getting paid on time, the agent not returning calls when they know you are phoning about a late payment etc. But they are never late with the 10% chagre every month for a service they do not deliver to their customer or the fee for finding a new tenant. Just Letting Uitenhage is terrible

Many thanks for this eye and mind-opening experience, and for allerting us on the common mistakes we should watch out for. I am already beginning to fear that I might be dealing with the same agency, whenever I send them written requests, they always try and avoid writing back to me...and when pushed, they only make a call. How do I demand that our communication/correspondences be written down. I see all the so-called legal experts have suddnely developed momentary amnesia...or are they chickening out. This is the moment and opportunity to present the facts...as expert advice. Is there a property lawyer out there still with some brain????

I would suggest seeing a lawyer not too optimistic when it comes to these tribunals. Had a complaint re Furniture city not honouring warranty claiming wear and tear (what crap) and followed the channels of complaint to no avail - I don't know what purpose they serve if they can't be bothered to help consumers!

I really feel your pain. do some digging around your complex find out if you are the only one with these problems if not set up a committe demand a meeting with the ergency,give them a pertition that unless all your problems (everyone i mean) are sorted or you will with hold that months rent until they sorted. it worked for us. on your own you wont get far but united you will be amazed.

Name and shame them. I'm new in CT, and my 1st lease was like that, telling me they can wait up to 6 months to repay me my deposit. I'ts a year now, still nothing, but they still advertise as being the best. I feel it's better to deal with the owner, for know, i'm in charge, and I can play the rules, so if he doesn't fix up, he doesn't get rent, so I force him to visit me.

The most important thing to do though when you start renting, document all the things that need to be repaired at least within 10 days, send the Agent a copy, and keep one for yourself. Secondly, when you leave, the agent and you must JOINTLY inspect the premises to identify damages caused by you. If you did not document in the first place, you are going to sit with the problem. But if there was no JOINT inspection, they cannot hold you liable for any damages.

Lastly, have faith in the Rental Housing Tribunal, and take them there. No need to pay a lawyer (unless you want to employ me instead (lol), the Tribunal won't cost you a cent. Good luck.

PS: report those unscrupulous agents to the Estate Agents Board too.

You should have inspected the property before signing any documents. You should have read the contract as well!! Plain and simple, no excuses.
If the agency is so pathetic, what guarantee do you have that the landlord is even aware of these problems ?
Your biggest issue seems to be a front door not locking? You got to be kidding me!! Worst case scenario, buy a new lock and fit it. The risk of losing that R200 for a lock is miniscule compared to the cost of relocating and breaking contract.
I'm quite curious to know what happened to your deposit you paid.
I would have loved to hear all 3 sides to this story.

Get a copy of the rental housing act to strengthen your case - you'll find most of the onus is on the lessor.

There are many of these agency's around Designer rentals are one of them.And another trick they all trying to do is keep your deposit see how many fault they find when you move out that they want to deduct from your deposit.

Dont expect too much from the Estate Agency Board or Rental Tribunal, they are inmany respects "toothless dog" (mimplied in the literary sense). Then also they only have jurisdiction of sorts over their members, and then they are probably not going to be in any hurry to bite the hand that feeds them either. My suggestion is lodge the complaint, but also publish the agency's name, whilst ensuring that you have all your ducks in a row and the proof in writing as you say you have.
I usually have no problems with agencies, typically they do do their jobs well. I am also happy that my tennants fix any nigling problems and deduct it from the rent, provided they give me invoices to back it up. So I would have had the door fixed and deducted the amount, but timeously informing the agency/landlord of my intentions and the reasons, that way any reasonable person would accept it.

I learnt the hard way to get everything in writing especially the things that need to be fixed after the inspection. We compiled a list together so when i left i made sure to fix the things i had broken to make sure i got my deposit back. After all my troubles and R1000 lost in repairs they still refused to give me my deposit (R4500) back because the list of things that required fixing was not signed??? Add insult to injury the previous tenant removed the satelite dish as she claimed it was hers. when i left the agency claimed the dish that i personally put up was the property's and asked me to produce the receipt(i bought it donkeys years ago) to prove that it was mine. So i lost my satelite dish as well

Firstly I fully agree with Juan@author put their names out there to protect other innocent people and secondly most defiently go to the Rental Tribunal - I was in a similar position and won my case. They are swift and very professional. Good Luck!!!

Just a few facts - balance of deposit must be repaid within 14 days of end of lease...if not levy Mora interest. Also seems a lot of tenants are unaware of right and obligations. Landlords responsibility is to provide tenant with "fit for purpose" accomodation at the outset. It is the tenants responsibility to maintain the property on an ongoing basis.

I'm almost sure their business model is to keep deposits! and I haven't even used them just know too many people that have been taken for a ride by them. Your suggestion will only help if that agency deals with several flats in the block, or the entire block if not sectionalised. What may well be the case, though, is that it could be one sectional title owner who is renting out his flat through this agency, and the others are all owner-occupied or let through various other agencies or owner-managed.

The best way to avoid rental agencies is to buy your own property. If you can afford to rent a house in a complex, it means you can also afford to buy your own property.

I must also say that this agency that JUST does LETTING is useless and corrupt. They tried to con me out of my deposit money, luckely I got hold of the owner who was also very dissepointed with their service and she TOLD them to pay back my deposit... The best way to rent is from the owner directly and the do the maintanance yourself. It saves you a lot of trouble... Also note that 12% of your montly rent every month goes to this agency that JUST does LETTING, for doing what...

Please!!! Whatever you do, do not go to a lawyer, you will break the bank and still sit with an unresolved issue a year later. Next time make sure that there is a maintenance clause in the contract which will give the agent carte blanche to perform maintenance via an approved service provider on behalf of the owner within one calendar month of registering the defect. One tip though, don't be petty, fix small things yourself, for crying out loud what does it cost to fix a door lock R100? thats peanuts and not worth kicking up any dust for.

My friends we have to name and shame them. I am letting out a flat through an agency and would, as part of their duties for the commission I pay them, expect them to relay these problems and if I am too slack they should force me to fix it! What a horrible experience!

I have also dealt with the same company that Does Just Letting in Pretoria East, sho', what a nightmare! from security concerns to bathroom cracks... and each time you are told that you are contracted to them for a certain period! i will never deal with them again!

Actually it was Just Letting that I have my bad experience with. Not the one in Claremont though.

They basically take the owner's word over whatever you say.

I'm definately going to go the EAAB and Tribunal route as well though.

She trades as "Sonje Botha Eiendomme/Properties" The town house we moved into was so clean you could eat of the floors! She is incredibly professional,I say go for small,independant agencies with fewer clients on their books,they just have more time for you

In our case, we have a complex on Old Paarl Road called Forestdale Villas, owned by a John Alias Gerrard Marais. Very unscrupulous man. I have been to the Mayor ( Dan Plato) and even the Premier ( Zille), but it seems this guys is connected politically. Sars says he owes Millions, but cannot be arrested!. You move in ( being promised that ur lease will be ready when you move in). Three months later, no lease. When it eventually arrives, IT is an ONEROUS contract. When you refuse to sign, you get thugs visiting u and your stuff being strewn all over the place. Then the contacrt says, if you miss the rent day by one day, the FINE is R1000. Nobody has ever got their DEPOSIT back. This guys is the owner/rental agency/security group/trustee/everything. No landline,fixed abode(address), no website, NADA! After you refuse to sign the contract you get kicked out and "forefeit" your deposit. It is a money-making spinner for the guy because he then brings someone in within a week and collects deposit as well....so it goes on and on!!!

withold the rental and see how fast they come running. I take that back it is bad advice but I have been tempted to do just. Most rental contracts are geared toward lessor and therein lies the problem. While there is things stipulated in the agreement that the owner must maintain there is always no mention of the quality of the workmanship or a time period. Typically owners are greedy unscrupulous individuals who know they have you over a barrel. Wait till you try and get your deposit back if you think this is bad.

I am renting directly from the owner - have the same problems. My front door does not lock - been like this for the past 6 months and still no response. If I phone him - he ignores my calls, does not respond to sms or message. All my emails are ignored. He only wants the money each month. What can I do?

Its not only tenants that have had problems with this specifc company that "JUST" does "LETTING". I was a landlord and dealt with the Northriding branch. I gave them my house for a year lease, and I think I got 10 months payments. The were useless at administring the place, I got paid my rent mostly on the 15th of each month, and never go the last two months payments. To top it all, the house was trashed by the tenant. If I can give anyone advise, please stay far from the compnay that just does letting. Take a look at hellopeter, there are millions of complaints about that company. And try to get hold of any management...you will never!!

I got evicted because of an unscrupulous agent and am now paying R2200.00 a month extra on rent. Called the Rental tribunal but they have no teeth really. How do I get to Cape Town to make a complaint if I dont own a car? I came very close to hiring someone to brake the jerks legs - I detest the fact that these arrogant bastards get away with murder and you basically have no rights.

I hate rental agents and estate agents. They've got only one thing in mind - MONEY, MONEY, MONEY.....! If they can nail you, they certainly will. No moral and ethical codes in this profession never mind what their mission statements at the reception desk say.

@ Leon - Gee Leon - I agree with everything - so next time I'm in another town and need the property inspected - I'll give you a call so please leave your number. It's impossible to inspect everything in a new building. I have a great landlord but I've now waited for 4 months for him to fix the toilet which was on the original complaint form. The window he replaced immediately and the front door that was falling out of the frame - ditto. My mistake when I looked at the house I didn't go around flushing all the toilets. Even if I did who was to say it didn't 'break' during that month I waited to move in.

I will not rent unless I deal directlky with the owner. Rental Agencies are a con, they make money for being money collectors and nothing else.

Speaking from an owner point of view - you have no idea what we have to put up with with estate agents that must let out our properties. It got so bad that we eventually sold all our properties because of tennants that destroy your property, just up ang go without paying,not paying their electical bill that the owner is now beinghold responsible for etc. I'm not for one second suggesting that you or anyone on this forum is guilty of such an indispicable act and I full heartedly feel for you to have gone through such a terrible ordeal, but in future, rather go the private renting route. It might serve your need much better.

As n property owner, I would like my properties to be kept in a good condition. Ir the tenant is unhappy about something, they could fix it themeselves and deduct it from the next months rental. I would also not like to stay in a property where the front door can not be locked. I would sent an email to the letting agency informing them that you are fixing it because you feel unsafe and that you would deduct it from next months rent and if they dont agree with it they should let you know in writing by the end of the current business day.

I own units and my advise is to give notice. I take care of my units as if the tenants see I have pride in it, it instills them to look after it as well, well most do, but I have had tenants that dont. I never use rental agencys, they are the WORST. They do nothing, dont even tell me when there is a problem, Just letting and ANGOR .. stay away fromt them

My girlfriend have a couple of flats she rents out through just letting and one privately. She had endless problems with the piece of scrap that rented privately And after getting rid of him Now all flats are going through them. MUCH MUCH less hassles, every cent worth!!!!!!!!!!

I had similar bad experience with a letting agent in Bloubergstrand. They collected the money on a monthly basis but never did any checks and did not even inspect my the property I gave them to lease when the tennant left. So of course there was lots of damage and I was the one that had to pay it. They refused to do anything for me. I contacted "Die Kampvegter" in Die Burger which in turn printed an article about their incompetence and it wasn't a week and I got refunded the whole amount that they deducted off the rent back for non service. Name and shame these guys. They are sharks getting in money and doing nothing.

Fix the front door yourself. It is not the way it is supposed to work but would you rather put your life and that of your family at risk instead of just coughing up for a new lock?

Subtract the cost of fixing the door from the next months' rent. The landlord will respond quickly then.

We had a terrible rental experience with Just Letting in Randburg. Fortunately for us we benefitted from their incompetence when they accidentally refunded us our deposit (part thereof) twice! We didn't advise them of their mistake, putting it down to compensation for "pain and suffering". I hope everyone else has some of our good luck with these fools.

Property Trust (Pretoria & Centurion). Try to avoid doing business with them for all the reasons stated above.

i rented a house about 17 months ago, and the estate agent (yes i'll name and shame), Vivienne Karamoutcheva, from Karawigs, disappeared with my deposit of R5000. To date, the EAB has not been helpful.

dont get me wrong as i am not sticking up for the agency at all but we do letting and sometimes the agent is caught in a catch 22. the owners have to give permission for any repairs etc to be done and deducted out of the rental monies...sometimes you just get pathetic owners that wont give their permission. if you are renting his property for the first time and dont know what he is like it can be really difficult on the agent. being a rental agent is the most unrewarding awful job in the world - no one does it for the love of it, only some that need the money - and trust me, if you work for a company doing rentals you really dont get a fantastic salary at all!!

Perhaps the best way to deal with scum like this is to make as much awareness as possible.

Whether you rent through an agency or through a landlord directly, you're going to get screwed, and thats the sad truth. Before my husband and I bought, we rented a subdivided house in Ferndale. The oven was so old it could only be switched off at the mains, and when we insisted it be replaced we were told no way. We replaced it ourselves, at our own expense and took it off the rent monthly which the landlord agreed to. He never fixed a thing that he said he would, reversed into my car and refused to pay the damages, and accused us of all sorts of damages when we eventually moved out - luckily we could prove were not our responsibility. All the fights and bickering were directed through an agent - we never spoke to the landlord directly, but essentially we decided we'd never rent again.

I have had the same problem, i met my agent for the first time this year and i have been almost living in my place for 2 years, i went through someone else, who was doing it on her behalf, and don't try and get anything done, they always in meetings, more like they don't want to be bothered with it and we have to sort it out and pay for the bill.... also don't dare try and pay your rent late, then you will get a fine, i have had that happen to me also, Agents are useless really they are and a waste of time and the sad thing about this all, the owner of place doesn't even know what is going on... and still paying them a fee each month....

I had various locksmiths out (at my cost) but the lock is in such bad state it cannot be replaced, the door itself has to be replaced - I am not willing to pay for that as it will cost way above my rental.
For all the wise-cracks suggesting we buy property - we are not all in the fortunate position to do so.

I have been three times to a court date that they have set between the landlord and myself. well i arrived everytime on time only to find that this government organisation has still not issued summons to them....talk about wasting my time and all i want is my deposit back. I am a landlord and made the mistake of using an agency that JUST does LETTING and it was one big nightmare. My tennant was paying her rent spot on every month, but I was stuggeling to get my money out of them. In the end I broke the contract, paid the tennants deposit back out of my pocket and signed a personal contract with her. I have never looked back. The agency steals your money and deposits!

Stay away from MME Properties (Principal Agent: Miranda Visser) - Cape Town (Kuils River), they try very hard to keep your deposit. I had to go to the Rental Tribunual to force them to pay my deposit.

According to Law rental agents must be paid members of the EAB as are all agents. I found out my letting agent was and is not a registered member. She stole my deposit after I moved out. The EAB is in the process of closing her business, as she is not entitled to keep any monies from the public in her bank account. Furthermore I am suing her directly. Small claims court.

We've had similar problems with our landlords for our business premises.Initially we dealt with a property management agency that they had happened,who were friendly and very helpful, but the property owners subsequently transferred those duties to themselves.After a year of complaining about a leaking roof, broken front door and several other issues, it has taken our lawyers getting involved to get things done. My advice is you chat to your attorneys about what remedies you might have available to you in the situation. Good luck

its hard for owners too - you let out your your home to make sure your bond gets paid and cannot even kick out the tenant who breaks fittings, burns carpets etc - and in the meantime your bond is in arrears. can sympathise having been a tenant through an agency but not all tenants are considerate.

More than I hate keeping someone money but sometimes the tenants ask for it...just now I paid close to R3000 fixing the property, with no rental paid as the property is empty(move out without notice) and this person is still looking for his R2500 deposit

I rented out my house using an agent and they did absolutely nothing. They just took their monthly commission. Tenenats stopped paying and nothing was done from the agent's side. When inspecting the situation the tenants left overnight and the electricity was swiched off months ago after the tenant failed to pay his electricity account. NEVER again, will rather manage it myself. They truly do collect money for no service whatsoever.

Good letter. It points out two things: ineffective rental agencies and naive people. I work with short term rental, and we keep ourselves small and boutique where we pride ourselves on our service, yet we are tied with a major brand. One thing that astounds me daily, is the naivety of people, who think they will make a fast buck out of the World Cup. People who will 'move out of our house for a few weeks'. What a joke. Do you people have ANY idea of what can happen to your house? I turn down 70% of the people who call our company, because I feel that they are not serious short term renters. Serious landlords are those who have their properties for hire all year round. You need to understand, that your house, whether you are long term renting or short term, will get damaged from usual wear and tear all the way through to blatent abuse. This is the risk you take for renting out - and it is your risk, not the agencies. Short term rental agencies are out there for one thing, to make money. However there is the 'right' way to do this and the 'wrong' way to do this. The lady writing this letter found one of the 'wrong' ones. And there are some disasterous 'Letting specialist' big branded agencies too. We believe customer service is king, and we are doing very well because 90% of the agencies out there don't give a damn about you. So the business eventually comes to us if you are serious about letting, because we are in this for the long term. You will notice SO MANY new rental agencies out there that have started in anticipation of the World Cup - no name brands, many of which will disappear as quick as they arrived after the world cup. Be wary of them. My advice is, know who you are dealing with, do your research beforehand, and make sure their strongest point is either finding rentals or management of the property, which ever one is more important to you. If you don't do your research properly beforehand, and you end up with a bum rental agency, I'm sorry to say but that is your own fault. SA is so poorly regulated and the EAAB is toothless, so unscrupelous operators flourish. This means you have to be very careful who you choose. My last advice is, don't have unrealistic expectations, firstly with making a 'fast buck' and secondly on every agency doing a brilliant job. I also advise if you have ANY emotional attachment on your property, even the smallest little thing, don't rent it out.

Your story, I am afraid, is not unique. There are unscruplous agencies out there and even branches of well know companies can give terrible service. Unfortunately, these days you must get everything in writing. If the house you were supposed to move to was suddenly not available, what were the reasons? You are doing the right thing in going to the rental tribunal, they will give you a fair hearing. try exposing the agency on www.hellopeter.com I have found that moaning about bad sevice there normally gets results.

Advice to potential Lessors and Lessees.
Choose your Rental Agent as you would choose any other facilitator for yourselves.
Firstly check are the regsitered up to date with the Estate Agents Affairs Board, if they are not do not even entertain using them. The EAAB may not be the best but any agent who is not regsitered with them is illegal and you will definitely have a problem. If the agent does not want to carry out suitable checks on you and also require all FICA documents then they don't know what they are doing and beware. Good Agents work in a Profeesional manner (unfortunately there are not many of them!) and you need to select carefully. A profeesional agent will ensure that you read and understand the lease agreement (Lessor and Lessee) and ask you to sign to day that it has been explained to you, that is the legal requirement.
It is however still a responsibility of Lessee and Lessor to be aware of, and understand the Rental Housing Act as that is the legal framework within which you are working, you cannot blame anyone els if you have not understood what you are doing or what is right or wrong, that is a responsibility.

Wow, wonder what the Rental Housing Tribunal will say to all these problems? Government should definately have a relook at a regulator that can actually DO something. Especially now with more and more people having to rent in this economic climate.

To clarify a few matters, unless you have written proof from the agency that you CAN do the repairs yourself and then deduct it from the rent, they will still hold you liable for the entire amount. And then they'll say you breached the lease agreement etc.

Coupled with the statement that 'they have to wait for the landlord's permission in order to effect repairs', I wonder if it isn't time for an ammendment to the Rental Housing Act to put in a minimum time for repairs/issues to be sorted out?

As a home owner who make use of rental agencies I would like to add that I have had to change my rental agency earlier this year because they did not pay my rent to me (eventhough the tennant was paying) and due to this did not contact me to inform me that there are repairs needed at the house.

I also reported them to the EAAB and got some of the rent back. Since I changed all the repairs at the house have been made and I am getting my rent in time. I do not live in SA so this doing this remotely is hard but definitely worth it.

Rental agencies are not doing their job. 2 weks into the new townhouse i am renting and the pipes broke and the house was flooded.the day I moved in I did the inspection and told them that the taps are losse and they said they will come fix them.I slept late vacumming and wiping water from the place last nite.I am yet to see them I dont know who will now incurr the costs to my damaged furniture and shoes.This has motivated me to get my own home by the end of the year.

They are never available, they don't answer your calls, they don't take your calls, they make promises not keeping them. They lie, they are incompetent. Had to write letters and threaten them with Beeld and Carte Blanche to get my money three months later. They must be closed down.

I know exactly what you are going through. We experienced basically the same thing with an agency called treasure homes. The only thing that they care about is to collect the rent on time otherwise everything else is delayed. I lived in the house for almost three years and nothing was ever sorted. The only time they did start sorting things was when new people were suppose to move in. So to all the readers beware of treasure homes on the east rand gauteng.

We are taking JUST LETTING to court as they have refused to give us back our deposit. The court appearance is sometime soon. They did nothing, no inspection when we first moved in, took months before repairs were made, had the workmen everyday for over 2 months and only one room left to live in out of a 3 bedroom townhouse. The manager of justletting was rude and only interested in having the rent paid, not helpful at all. i wish i had know about them before i used their services.

I rent out my cottage in Woodstock and am lucky if I receive the rental by the 21st of the month...maybe it's the agent who is holding it. Am I allowed to contact the tenant directly to ask if they are always paying late? How many days/weeks notice must I give the agent if I want to inspect my cottage?

There was an agency in Edenvale who JUST decided to LET my townhouse to some people who hung torn duvet covers up in the windows instead of curtains and never ever paid any rent. When we tried to show the townhouse to new prospective tenants the renters were dancing and chanting outside on the lawn. This was in spite of me insisting I am a very fussy landlord and I wanted to have the final say as to who we accepted.....they just signed up the first people who came along with no checks whatsoever, seems like.

Let me just say,I am an owner who got a tenant via an agency. They claimed to have screened the tenant. From the first month I had a problems getting my rental money on time. The agreement between the agency and I was six months renewable. I did not renew and they never called. I think also they are just making money by getting anyone from the street to rent your property and they get their commission (commission was paid in advanced). I started collecting my rent money myself every time it was late but I forsaw a problem with this.I saw that I will never have prove that the guy will pay as late as the 20th of the month.So now even late payment I requested to be bank deposited for my own claims.

the same company rented out my house ,i had moved to another town and left all in there capable hands,to my disgust 16 months later when my house was being sold i was notified by the new buyer that he would take the house but for R150000 less because of the state the house was in.contacting the company they still only sent a agent to do a follow up inspection after my 11th call to them,the tenants had really distroyed the house as no agent visited them to do inspections as promised,i lost R150000 because the letting agency just didnt do there work.i will never ever use them again

I agree with Hugo. My daughter also rented a house for a year and I told her at the beginning to make a list of all the faults and keep it on file. She was told by the owner - via telephone - that the problems will be sorted out. I personally went and cleaned around the bath. The wooden windows couldn't close properly as they were swollen from the winter months. She was told a security gate would be fitted. In the year she lived there no one came to do spot checks - in fact no one was with her when she moved in. She collected the keys from the owner's office. When she moved out the owner was there to inspect the house which was actually in a better condition than when she moved in (she had aluminium blinds installed at her cost). But now the problem - NO DEPOSIT WAS PAID BACK TO DATE even after numerous phonecalls. He keeps saying the money was deposited but he cannot give me proof - i.e. a deposit or EFT slip. This owner is Ray Langman of Ray's Towing.

I agree. Name and shame. These agencies are really something else and should be outted. I am far from being in the legal profession, but I have read that the landlord is supposed to put your deposit into a bank account and when he pays it back, he is supposed to pay back all the interest that was earned on that money for that period, because technically that money still belongs to you. If you had invested it, you would have earned interest on it. Would be interesting to find out if that is the law and if it is actually been happening.

I dealt with the agency called Just Letting from a landlords perspective and it was a nightmare!! The were suppose to collect the rent, promised a lot and delivered nothing. I had to get a layer to get the rent out of the tenants and get them out of the apartment. Stay away from them. Just do a SA Google search and see how useless they are.

Its sadness and nightmare to rent an apartment with JUST LETTING – PRETORIA CENTRAL.I have once lived for about 3 months with no toilet, now its my 4th week with no electricity and stove. Every time when I complain they always tell me to write a letter of which I did. I have called the office numerous times but their receptionist is rude and she can’t help me and she is also not allowed to transfer my call to the relevant people.
Ooh before I go I forgot to share something, the last time they came to paint my PC display card went missing of which I was told to write a letter but unfortunately they could not help.
Please I need people ‘s help because I wanted to move out due to all the maintenance problem that I am having but I was told that I will forfeit my deposit.

Ok, so which rental agencies are the good ones?
I am a landlord with my home on the market who does not want to take advantage of or be taken advantage of. All I am interested in is for the tenant to look after the place and leave it in at least the same state they found it in when they moved in (and believe me this is 99% impossible, based on my previous experience with tenants), as well as having my rent paid on time.
My side of the bargain has always been to ensure that any faults are repaired as soon as humanly possible and with the minimum disruption to my tenant, as well as ensuring that the tenant’s deposit is refunded in full at the end of the lease (assuming that the tenant has looked after the property and has not destroyed it).
Some of the past experiences I have had the pleasure of being on the receiving end of from tenants are:
1. Tenant not paying rent for 3 months, as well as not paying water and lights for 3 months (even though I went through a rental agency). When pressurized the tenant simply disappeared, with me left carrying the can.
2. Tenant moving out at the end of the lease and me having to clear 7 tons (yes, read my lips) of garden refuse as the garden had not been maintained at all.
3. Had mushrooms growing in my lounge as the tenant did not bother cleaning the place during his residence. Also had bad cigarette burns on the carpets in the bedrooms, which I had to replace – how some people can live as pigs is beyond me.
4. Tenant making excuses regarding payment of rent – rent not paid for 2 months. When I called the tenant to try and resolve (in a polite, understanding manner) I then received a letter from her attorney stating that I must stop harassing his client for my rent!!!! Needless to say I had to physically throw the tenant out of the property to resolve the issue.
Based on the above experiences the only way I can cover myself as a landlord is to charge at least 3 months rent as a deposit as a single months rent as deposit does not come close to covering the damages my property has experienced from tenants.
I can go on and on and on.
So, I would really like to know who the reliable and efficient renting agents are for a property situated in Olivedale Randburg. Any info in this regard would be much appreciated.

1. If you signed a lease for the property that then became unavailable, then you should have enforced that lease.
2. Don't understand why you signed a lease for a property you hadn't seen
3. If the property wasn't as described - then yes - get everything in writing from them!!!!
4. Take action against the owner - they are more likely to sit up and listen and after all, the agency is acting on their behalf

I feel the same; my problems started when we moved in April this year - Firstly Realty 1 Centurion went under and my "deposit is tied up in a court battle tha I will not get any thing. Then Just Letting Centurion - The house has several faults that now 6 months later I refuse to pay the last months rent as I personally put in R2000 and a lot of time to get the house ready for our use - Nothingh was done to reclaim thin. The Owner is now saying that she will cut the Water and lights - Can she do this?

I am a tenant that has just signed a leasing agreement under false pretence. I was assured that there was an aerial on my property - only later to find out there wasnt. I was assured that there had been no break-in and theft in my complex - only to be broken in to and when I asked the neighbour, break-ins had been happening for the past 2 months prior to me moving there. When I tried to call my agent for advise and assistance regarding break-in he wasnt available. And since my front door was kicked down, I needed to make alternative arrangement for my own safety and the safety of my property. And if there wasnt enough drama for me. I went back to the property 2 days after break-in only to find my door replaced and locks had been changed. Agent didnt bother contact me regarding new keys for property. So what I am suppose to do? I'm now homeless and still expected to pay rent??
