Pietermaritzburg - Individual overtime claims at the Msunduzi municipality have reached shocking proportions and evidence indicates that many security staffers are getting away with earning fat-cat salaries at ratepayers' expense.

According to a list of just 36 of the municipality's many security personnel, singular overtime claims per person for July and August range from R3 731.56 to R53 980.74. These amounts exclude basic pay.

In one case, one of deputy mayor Mervyn Dirks's bodyguards pocketed R45 578.49 for overtime in July, while August saw him take home an overtime amount of R47 988.95. This adds up to an individual overtime total of R93 567.44 in just two months.

A bodyguard for Mayor Zanele Hlatshwayo received R37 534.70 for overtime in July and his August overtime pay reached R46 592.88. His two-month individual overtime total amounted to R84 127.58.

Guard in training pocketed big bucks

Another employee earned R31 933.72 in July and R53 980.74 in August, bringing his two-month total to R85 914.46.

Another received R34 327.86 for July and R39 983.58 in August, which amounted to R74 311.44.

September salary slips in The Witness's possession tell the same story.

A security officer in training pocketed R39 085.20 in overtime, almost four times his basic monthly salary of R10 245.55. His gross earnings for the month were R52 270.55.

Even refuse collectors are coining it. One managed to pocket R15 030.40 in overtime for September, a major boost to his basic monthly salary of R5 328.12. He grossed a tidy R21 371.07 for that month.

Overspent on budget

Last month, The Witness reported that the municipality had already spent R25m of its R33.5m overtime budget barely three months into the new financial year.

Hlatshwayo said at the time: "It seems to be unregulated and it is all over the place in waste, in traffic, in security."

At the end of the 2008/09 financial year, The Witness reported that the municipality managed to exceed its R43.4m overtime budget by a whopping R22.5m.

Asked to comment about the municipality's poor financial discipline, Dirks - who is acting mayor in Hlatshwayo's absence - said it is an administrative issue that the relevant managers should comment on.

Deputy municipal manager for community services Zwe Hulane referred The Witness to municipal manager Rob Haswell for comment, but Haswell did not respond by the time of publishing.

Attempts to get a response from the municipality's chief financial officer, Roy Bridgmohan, were also unsuccessful.

10 hours+ overtime illegal

According to the Labour Relations Act, it is illegal for employees to work more than 10 hours of overtime a week.

In a report by Haswell on October 8, titled "Reduction Overtime Expenditure", he admits that the municipality is contravening the act and spending too much on overtime.

"From a budget of R33.5m for the 09/10 year, we have only some R8m left, and many employees are working for more than the maximum 10 hours of overtime per week as prescribed in the act," wrote Haswell.

"I'm absolutely horrified," said DA councillor Bill Lambert.

He told The Witness his party has raised the overtime issue constantly in Exco meetings, and Haswell was ordered to bring a report to Exco explaining how he is going to save council's overtime money.

"If it was known that these people were exceeding the legal overtime limits, why was it not acted upon? This is a joke that's not even funny," he said.

IFP councillor Dolo Zondi said he had asked Exco in the past to get an assessment risk level that would probe whether bodyguards are indeed necessary.

"It's not opposition parties that are threatening them. They need bodyguards to protect them from people in their own party."

This is what we end up with corruption is not checked! Mervin Dirks must be one of the richest people in the country .. courtesy of the rate payers of PMB! There is no service delivery in this city. Councillors are lining their pockets ... this overtime pay is certainly not going to one person... BUT being shared with these corrupt officials. When is the ANC going to do something about corruption in our city. People like Kevin Perumal and Mervin Dirks are NOT qualified and just don't have the skills to manage a big city with big budgets! How good were they at school?? Certainly at the bottom of the class ... and they had the opportunity to study... if they had the brain!! Too lazy at school, now they want to manage a city!! What a joke! Please get rid of them and employ suitably qualified, highly skilled, hard working people to run our city of choice.

I think there must be a compulsary course that the councilors should go through which should teach them about finances. in conclusion, i think all those who are responsible for this theft must be fired. there are many educated and competent people who are looking for jobs but nepotism by government departments is standing in their way. please Yashua help us Tax payers, we are paying to get service and support the poor. not this morons.

For somebody who earns R5500/month which equates to R31/hr, The person would need to work 250 hrs at double time, R62/hr to earn R15000 in O/T. A normal month is 181hrs therefore this person worked 1.5 months of O/T as well as his normal months work all in 1 month, this equals over 60 hrs per week in O/T. They have found a scam and are milking it. Just shows you the lack of controls in PMB

Amazing how a party with a 70% approval rating from voters needs bodyguards (security guards in training) to protect them from themselves. Fire the lot of them, then prosecute them for fraud. Jailtime will send the correct message in the quickest time. All this wasted money could have paid for power stations and hundreds of thousands of houses in totality - simply squandered on egos. Is there anybody, anywhere more stupid than a South African voter? I doubt it more and more each day.

This is ridiculous. In the private sector, when times are tough all over time is stopped and needs prior approval. Surely the solution to this is simple, issue a directive from national treasury stopping all overtime at municipalities, they are not delivering services during normal work hour, it begs the question - what are they during in the over time hours. I also don't believe that it is phyically possible to work these additional hours.

I find this very interesting. Using the refuse collector as an example (as his monthly income is provided), given 21, 8-hour working days in a month, he earns R32/hour. Overtime rates on Sundays and public holidays, if I'm not mistaken, are 2.5 times your normal rate. That equates to R80/hour. For the refuse collector to have earned R15030 overtime in one month, he would've had to work 188 hours of overtime (on Sundays and/or public holidays) - that's 23.5 8-hour overtime shifts. They work more hours overtime than they do 'normal' time. But this is obviously all above board, isn't it!!! It is not long now before total ANC-endorsed anarchy reigns...

Clearly these people submitted fake overtime timesheets. If you just take away 8 hours per day for sleeping, then the absolute maximum hours you have left per week will allow you to earn 3,44 times your basic. In other words, removing only 8 hours per day for sleeping, if you earn R10 000 per month, you can increase that to R34 400 per month by doing every other available hour overtime. If you remove a further 3 hours per day, then you can tripple your salary. In those three hours you need to do everything but sleep and work: eat, shop, shower, travel. In three hours a day? Can I be a security officer in training?

There are employment rules posted in almost every office in these municipalities. The employees know them mostly by heart. Thry and push the window where the meployee's rights are infringed then the union reps are called or even a strike. YET, when the employee mushes the window knowenly for financial gain then the rules are ignored. You either abide by these rules or you dont. The managers in these positions have to be taken to task by allowing the abuse of the overtime plus employees who gain financially by these illigal practices. tHE ccma must STEP IN AND CORRECT THIS PRACTICE as the system is now abused

My dad works for ethekwini municipality. Overtime claims by artisans were high, he queried them, and the artisans warned him not to mess with the 'system'. My dad doesn't frighten easily so he reported them. But the warnings stand. He may lose his life because some municipal employees are looting the system via overtime claims. In this case, breaking water pipes so that emergency call outs in the night end up with overtime 'opportunities'.

The Municipal Finance Management Act makes the official approving such fraud personally responsible. It is time that the remedies provided in this act be implemented. If the steps are not taken from within, the DA must get a court interdict/ mandamus to have the law enforced. Only if the money is recouped from the individuals will this fraud stop.

It is unacceptable, there should be an investigation and heads should roll. Mugabe can come and learn from you guys just how to be corrupt and drain an economy.

What we need is a National Tax Trust fund where we can pay all our taxes and municipal monies into until we are SAFE, get service delivery, governmental and municipal fraud stops. This is the only way they will learn the crime does not pay. Hopefully one of the major law firms or companies like Deloitte and Touche can come to light and start a trust for the SA public. People over the whole spectrum should benefit by supporting this idea. Government will then only be able to lay their filthy hands on our money after stopping corruption, getting rid of ALL the culprits and employing capable, honest people.
