State 'took chances'

Pietermaritzburg - Judge Herbert Msimang, who presided over former deputy president Jacob Zuma's corruption case, said on Wednesday that the State's case "limped from one disaster to another" and it should have investigated further before charging him.

Zuma's corruption case was struck off the roll by the Pietermaritzburg High Court on Wednesday.

Delivering judgment Msimang said Zuma had to be treated the same as any other person, irrespective of his position in the country.

"His standing in the community will not alter his position in the eyes of the law."

The thousands of people gathered outside the court in support of the ANC deputy leader erupted into cheering and shouting when a large group of chiefs wearing traditional clothing ran outside waving their sticks in the air to break the news.

Msimang said he needed to take the "spirit of the Constitution" into account when making a judgment.

He pointed out that the prosecution's case depended on the outcome of appeals against controversial search and seizure raids, when documents were seized from Zuma's lawyers and from Zuma.

Msimang said Zuma had suffered social prejudice which "closely resembles punishment that should only be handed to a convicted person".

He said the state's decision to prosecute was "anchored" on unsound principles.

The State's case "limped from one disaster to another" and it should have investigated further before charging Zuma.

He accused the state of failing to take into account the legal challenges to the search and seizure raids.

The state was "taking chances that the trial court would come to their rescue to admit such evidence".

Msimang said the state did not "need to take chances".

This is a bad example to set for criminals. This country is rife with corruption & evil & people are getting away with it on a daily basis. We need to take a stand. The prosecutors need to know what they are doing & not waste tax-payers money. The running joke around the world is "that you can only get into government if you have been in jail"! Please bring honest, reliable & decent people into government who aren't going to try rape SA as Zimbabwe has been raped by it's so called 'leader'.

We are all screwed now!! the court has effectively turned this gentleman into a matyr and what's to stop him from becoming the next president. We might as well become another province of Zimbabwe because a person with such a legacy is a joke to the international community, "big business" and definitly bad for prosperity. just like bush or bob!!

I think is the time that Zuma must quit politics and join the private sector. I don't Zuma will make this country any better.He does not desereve to be SA president.There was a lot of bad things that Zuma allegedly did, which makes him not fit for presidency.

Unbelievable that the State made a mass of this . They should have first prepared properly and not rushed in as they far too often do . A great tragedy for RSA .I hope they will be properly prepared next time .

So, now its confirmed who the next president will be. What a sad day it is indeed and what a laughing stock we must appear to be. First world countries must be rubbing their hands in glee with the expectation of the flood of qualified people that will flee rather than being ruled by corruption and a false democracy. Sorry South Africa, but bye-bye from a once hopeful South African.

I welcome the rule of law. my question is where to from now? I ask this question because people have been taught an insolent behaviour in defence of a hero. Can we now teach people respect for authority and basic human respect again? only time will tell?

The judge was right to dismiss the case because the prosecution stuffed up. However, all hell will now break loose in the ANC as we watch the power struggle for leadership. The watching world is not impressed, expect the Rand to plummet to new lows.

i am not a Zuma fan and dont want him to be president of the country, but the comments posted here seem to have a more ratial tone than anything else. People like Basson and other got off on technical grounds. The important thing is has the judgement been the reflection of rational law... it has. White South Africans usually show their racist nature when things dont go "their way"

Well well well. Zuma is advancing, honesty will always win at the end. I am very happy. The justice system must be fair, yesterday a white man who ran over a black boy twice killing him only got 4 years, and people expected Zuma to go to jail, for what?. Politics in this country are going to get very interesting.

Don't the supporters of Jacob Zuma see that he is damaging the international status of South Africa with his lack of integrity? How can they possibly hold their heads high and support a man with absolutely no moral standards.The 'African mentality' which blindly follows leaders irrestpective of their actions is dragging South Africa down to the shambles of the rest of Africa. Zuma was only acquitted because of poor prosecution, not because he is not corrupt. Can his supporters not grasp this?

Bulelani once said they have a prima faciae case against Zuma , so what did Pikoli and NPA find that which Bulelani couldn't. Anyway is time for him (Zuma) to resume his duties as the second citizen of the country because Mbeki released him so he could stand his day in court of the land and now that all charges have been dropped against him by the same courts , it is beffiting for Mbeki to reinstate him with the same immediate effect he was dismissed him with .

It seems that once again we find the court's punishing the prosecution system for it's unfortunately obvious non-adherence to the rules of order. At the end of the day however it is not the lawyers that suffer but the people in the street who will inevitably suffer the consequences of the release of the (and i am not refering exclusively to the Zuma trial) alleged criminal. The real question is how the ANC and tripartate hierarchy will respond to the comments of himself and his supporters

Finally the prosecution of this man will stop. It is sad that the state has wasted so much of money on such a poorly presented case that is dependent on appeals of searches made after they charged Zuma. Clearly they did not have sufficient evidence to charge him but did, and then went on a wild goose chase looking for evidence. They should be charged for wasting tax payers money.-satish
