Johannesburg - Traffic offenders were made to spend the day in police cells on Wednesday after being arrested for "minor" traffic offences.

Seventeen motorists were caught at the President Fouche Street-Malibongwe Drive intersection in Randburg, and another six at the intersection of Gordon and Hendrik Potgieter roads in Florida.

Those who were taken to Florida police station were freed late on Wednesday afternoon on bail of between R800 and R1 200, while others still were being detained at 20:00.

Johannesburg metro police spokesperson Wayne Minnaar said the motorists had been arrested for ignoring traffic signs and direction signs, turning where they weren't supposed to and driving on the yellow-demarcated shoulders of the road.

'Like a hardened criminal'

Stephanie Bentley, who had to have trauma counselling after her "nightmare day", said she was dumbstruck when she heard at 07:00 on Wednesday morning that she was to be locked up for turning where she wasn't supposed to.

"I've had one speeding ticket in my whole life and now I'm locked up for something minor like this as if I'm a hardened criminal," she said.

She was released at 16:30 by Florida police.

A furious Jon Dare, whose fiancee Kirsty Nicholas had been locked up by Randburg police, said it was madness for motorists to be locked up on such minor charges.

"Taxi drivers hop across two traffic lanes at a time, without signalling, and nothing happens to them.

"Now, our loved ones are treated like animals for an innocent, minor mistake," he said.

The father of another woman who was locked up added: "We had to feed them through the bars, like monkeys. They weren't even given water, the whole day."

He asked to remain anonymous.

Pralin Naidoo, who was arrested for making a wrong turn at a robot, said he was pulled out of his car and thrown into a police van.

Thought they were joking

Melanie Jansen, his friend who was left stranded at the robots, said she did not have a driver's licence, but metro police continually ordered her to move the car, or it would be towed away.

"I thought they were joking with us," she said at Randburg police cells.

Naidoo's sister finally moved the car.

Police and family and friends drove some of the cars of those arrested to the police stations.

Lawyer Felix Majoni, who was at the police station to secure the release of his client, Flanagun Mapayaenda, said such arrests placed an unnecessary burden on South Africa's justice system.

"You don't have to have a law degree to know that you can't just lock someone up for goodness knows how long for a minor traffic offence.

"There are murderers and rapists out there, and this is how they're wasting the state's resources."

Zero-tolerance policy

Minnaar warned, however, that similar arrests could be expected on Johannesburg's roads, on an ongoing basis.

"We're making it clear that we're adopting a policy of zero-tolerance for traffic offenders this festival season."

He said every case would be heard on merit and the decision lay with the courts to fine offenders or jail them.

Those arrested were due to appear in the Roodepoort and Randburg magistrates courts on Thursday on charges of reckless, negligent, or inconsiderate driving.

The police in South Africa are too terrified to catch and arrest real criminals. That's why the pick on "soft and easy" targets like motorists and strip clubs.It's easier than tackling real crime in Hillbrow or stopping taxi drivers !

Would not the only reason for being locked up on a minor offence be because of no proof of identity,but locking up people where they have id,license's etc is a violation of your constitutional rights.These are the kind of offences where a fine is supposed to be issued by an officer.So this tells me who ever is in charge of the Johannesburg Metro should be brought to book to account for the actions in Randburg.

I just wish that they will prioritize, when some one has been raped they say that they will do everything in their power to find the persons responsible, while they are busy arresting people for MINOR TRAFFIC offenses. It is stupifying.

This is absolutely ridiculous that drivers are being locked up for such minor offences, when a whole Judge gets caught drink driving and nothing happens to him. That says a lot about the justice system in South Africa. No wonder crime rates are so high!!!

Whilst bad drivers should be penalised, locking them up for minor offences like this is beyond comprehension. No wonder SA has one of the highest crime rates. Cops and authorities are spend all their armour on soft targets - drivers, people without ID, illegal immigrants and leave out real criminals shooting innocent people, raping kids, hijacking cars etc. Shame on you the police!!

I didn't see the list of people arrested but judging by the article above, there doesn't seem to be any taxi or truck drivers in the group that was locked up. I bet you guys went home with the adrenalin pumping after a day filled with all these dangerous arrests you made...

It seems as though you are better off comitting a murder, you get bail a lot faster, that is if they look for and catch you. Or drive a taxi the cops are scared shitless about stopping a taxi so they are a law unto them selves.

As a nation, we South Africans do not respect the law. We bemoan the state of crime in the country, but still disobey traffic laws, talk on the cell phone while driving, speed and drive while over the legal limit. Our attitude is that my crime's OK because there are more serious crimes out there. I believe that police are justified in taking this action as a deterrent....then they can focus on more serious crime. Stop the whining, respect the law and support law enforcement at all levels in SA

Bizarre. How about cracking down on real crime. Not a day goes by without at least a dozen murders being reported ... but now people are being locked up for minor traffic offences. If police and the government were serious about getting tough on crime wouldn't they pursue REAL crimes? Truly and utterly flabbergasted at the mentality. Yes, by all means, get tough on motorists during the festive season, but how about also targetting the taxi's who barely have four wheels???

I find it amusing that some of the "victims" try to shift the blame away from themselfs by commenting on how taxis drive, or how murderers etc are free. Live with it ! You disobeyd the law, and you were caught. A Law is a law, and breaking it makes you a CRIMINAL, NOT A VICTIM. Well done to Metro and all other on their ZERO tolerance policy. There have been complaints about drivers at this and other intersections in the area for quite some time now. Letters to the local newspapers by residents have urged the traffic department to act, and they have, admittedly harshly but probably VERY effective. These and other drivers will think twice before doing this again!

I have to agree with most of the people that where interviewed in this article. This is absurd!!! Taxi's...need I say more! They are a law in their own and I have never seen a taxi pulled over for practically pushishing other cars off the road to weave through traffic and in process putting their passengers and other road users in danger. Rapists and murderers...relax...You seem to be safe as police seem to have better things to do at the moment! RIDICUALOUS!!!!

There are murders and rapes going on every day and the taxi's are a law unto themselves and this is how the police act? Arresting people for not stopping at a light or intersection? They don't stop because they fear being hi-jacked by the very people the police cannot catch through their incompetence.

Is it just me or is the Government Cross eyed between ACTUAL Crime offenders and petty offenders. Why can a Rapist be set free in a day, but the LIGHT traffic offenders must be locked up ,just to be shown a lesson? Our country is croocked. They are making criminals out of normal decent people. They are traumatizing the wrong people. We are more afraid now of violating a traffic sign, than the police themselves. What is going on here? I`m very dissapointed.Disgusted.

How ridiculous. Firstly you get arrested for having outstanding fines. When did it become a criminal offence to have an outstanding fine? I agree when you have missed the court date, that they can arrest you. Once again, some of the dysfunctional depts. Pray on the easy money. Like quick cut offs for electricity, additional charges that we get on our license disks, and now, having to post bail for turning from the wrong lane. How about arresting the 2 traffic official found sleeping in their car?

This is absolutly shocking , i travel that route almost everyday and watch the taxis travel on the wrong side of the road even on the pavement and hooting for pedestrians to get out of the way, i understand why people will drive on a yellow line or turn at a red robot to join the freeway , its cause the taxis do even worse and get away with it , when are the traffic deparment gonna get the b@lls to stop these guys , its amazing how scared they are of the taxi drivers.

About time. I'm so tired of South Africans freely commiting what they term "minor" infringements of the law purely becasue there are larger, more pressing problems out there. Instead of throwing up our arms and crying "..but there are hardened criminals out there...." and criticising the law enformecent agencies, we should congratulate and encourage them for finally taking a step in the right direction. Zero tolerance means zero tolerance.

In general I believe that they are only after soft targets. They are placing undue pressure on the criminal justice system by doing such dof measures. When the case comes up in court the officer who wrote the ticket should be in court (plz correct me if I am mistaken) thereby taking another law enforcement officer off the streets.

It is very quick to always shift the blame to taxi's whenever someone is caught doing a traffic offence. If we as normal drivers stop breaking the law - like going through red robots, turning where you should not turn etc the metro police would have more time and resources to concentrate on taxis. I very seldom have an incident with taxi drivers - it is the normal driver that causes more problems on the ride.

Instead of paying metro cops to sit behind bushes and police to arrest motorists for minor offenses, they should be out patrolling on a daily basis, managing those busy intersections and be visible. Making money via fines is not the job of law enforcement.

What a joke !!. The only reason selected cars,no taxi's ever,are stopped for minor traffic violations is so the Metro Police can line their back pockets !!. No taxi's are ever stopped for the daily chaos and carnage they cause on the roads and there are two reasons for this : 1) It is not lucrative enough for the Metro Police because the fines will never be paid. 2) The cops are scared of the taxi drivers knowing they could get shot because taxi drivers have no respect for the law or life !

How many articles do you read on this site that at the end state ?no arrests have been made? for hard crime like rape, murder, and fraud ectr? Yet people are getting locked up for minor traffic offences? What about illegal Toyota panel vans converted into taxi?s carrying 30+ occupants that every week you hear about killing multiple people? Near every day on my 80+km commute to work I see taxi?s doing illegal manoeuvres to get as many people packed in, often with traffic police in plain view, yet they do nothing knowing the chances of getting any money out of a taxi owner are near null. Its simple, if the legal and justice system is so pathetic that they cant do the job that they are intended to do, they would rather just pick off soft targets, probably to pay their Xmas bonus.

Breaking the rules of the road is still a crime, even though people think its "minor" So many backlogs in traffic are caused because of people going in the yellow lane then pushing back into the traffic - Hendrik Potgieter/Jim Fouche is a brilliant example. Turning right in a straight only lane - Krugerrand/Hendrik Potgieter!! Maybe the Traffic Police are too scared to stop the Taxis??

If this type of action was being implemented across the board, extending to ALL traffic offenders, it would be somewhat understandable. However, the fact of the matter is that it is not being implemented fairly or consistently. If so, why are we not reading about taxi drivers being subjected to the same? Another example of govern-mental led incompetence. Well done boys. I truckload of donuts is on it's way.

Thank you Wayne Minnaar for pointing out that the decision was with the courts who should go to jail. Please could you then elaborate why you can throw motorists into holding cells without going to court first instead of issuing a summons? Have you ever wondered why your Metro Police have such a poor public image? They are nothing more than "Traffic Cops" and I believe they are taking their frustrations over their low self-esteem out on people who have committed petty offences.

I seriously cannot belive this story! To think that we have all been moaning to the countries leadership to reduce crime and come up with this brain fart! Resources get spent on this sort of BS while serious crimminals roam freely, not targeted by this resource spend! p.s - Why lock us up when clearly in front of 'many a metro' official's eyes taxi drivers do the same thing about 120 times/day! We have to realise that this is Africa and will always be a place were ridiculous things happen. Our Police, regardless of all the crime(serious or not) do not have a clue what they are doing and riducle themselves when doing things like this - when a person cant tell the difference between a serious crime and minor petty traffic offences, it makes a person understand what kind of people run the the country and the people they have working for them.

Taxi drivers or do they pay the Xmas bribe to ensure they are not arrested? I am to appear in court for a traffic offence that I did not commit - the car that was caught speeding is not mine nor registered on my name thus no connection to me. The registration of the vehicle was incorrectly added to my ID number and thats it! Have you tried to rectify this problem? It is an endless problem but the court appearance still stands and I have also been issued with a summons (formally). Please advise.

As one of the daily drivers along the President Fouche/Malibongwe route it is extremely frustrating, not to mention downright dangerous, for people to make the illegal turns that they do at that intersection. I welcome their being punished for BREAKING THE LAW (no matter how petty that might seem next the murder rape etc). Everybody has to learn to take their turn (taxi drivers included!!!) We need consistency though - i.e. metro officers there regularly.

I too was pulled off,for not stopping at a NON STOP sign street, so did 30 taxis after me, I got a R500 ticket, I think cops are Bias/racist.I showed them, but they ignored me.What does one do about this, they all the same.

whilst I think South African drivers are arrogant and inconsiderate at the best of times and do whatever they like on the road,the Taxi drivers just carry on regardless and no action is ever taken against them.Personally ,I think the cops are to scared to deal with them and as such the taxi drivers do whatever they like.perhaps if the taxi drivers had their taxis confiscated and heavy fines imposed things would be different.Africa wins again!

Lesson learned. Dont ignore traffic signs !! Stop moaning about it. I agree that taxis should be nailed along with everyone else, but if you do something you shouldnt be doing, you have to accept what happens. Its not tolerated in most countries so why should we be any different. I cross a pedestrian crossing daily to get to work. The red light is ignored as a matter of course. People have to run for their lives. I take my life in my hands twice a day, All due to 'innocent' people ignoring signs!

I think the Metro Police are just out get money again this Christmas season. I received a R1000 fine in Landsdown Road for 'driving in the bicycle lane' to turn left in a side road by overtaking a bus on the left cause a vehicle in front of him wanted to turn right. I ride the same road every single morning in and this morning again I was driving behind a Metro Police vehicle when a taxi came past on the left side and 'driving in the bicycle lane' and he did absolutly nothing. It's a joke!!

This is absolutely frikkin ridiculous, to put people through this kind of trauma ,when there are bigger culprits out thereon the roads who risk peoples lives every day by their total disregard for any traffic laws. I wonder if someone in the system doesnt have a big enough bonus this year and this is how they plan to rectify the problem!!!

Dont get me wrong I have had moments behind the wheel on my cell phone or ignoring the rules of our roads. But we are surely wrong when we do this?! Or are we exempt somehow? Who do we think we are? There are consequences to not abiding to our laws and we are beginning to forget this in this country! Well done Metro Police!

Great move, I don't have a problem with this but let's just make sure that ALL drivers committing such illegal tactics on the roads are locked up for the day. Settle ALL fines before getting out and make sure bail is a good amount to pay for the legal system to prosecute and fine. In the new South Africa let it be democratic and no matter who you are or what colour or what religious belief?.?break the law and get put behind bars.

Arrest like this is illegal - you have to have committed a CRIME or be suspected of criminal activity to be arrested without a warrant. I am all for zero-tolerance but do it properly!! Issues: cell-phone use while driving; taxis in emergency lanes on highways, speeding, thinking they are above the law; taxis disregarding red lights; yellow box lines at intersections which everyone ignores... we need more cops on highways and signage warning of stiff penalties with proper, LEGAL enforcement.

I find it so ironic that when a top judge of this country drives way over the legal limit with eyewitnesses, the case drags on and on but the man on the street can be whisked of to jail for minor offences such as this! Funny how the law only considers some people in this country, which makes the subject of emigration so much more attractive.

I believe that the JMPD have every right and are well within the law to go about these arrests. People on the roads of Johannesburg are so caught up in the lightening speed lifestyle that they inevitably do disobey the rules of the road and break laws endangering innocent lives in the process. The very disappointing thing is that no taxi drivers are reported to have been arrested. I find it very hard to believe that at this particular time no taxi?s committed any traffic offences. People would appreciate the work done by the JMPD if every road user is treated the same. NO TAXIS WERE CAUGHT? COMPLETELY LAUGHABLE!!!

It seems more and more is being done to scare the 'paying' market. Why not rather deploy officers to hot-spots of drunk and reckless driving?? Everyday I am frustrated by vehicles driving on the dirt at speed and then pushing infront of patient motorists. Why is nothing done about this? Surely a taxi filled with 20 people driving at 60km/h+ on the dirt should be of much greater concern for public safety (including the passengers in the taxi!!)

So many people on our roads have started ignoring traffic rules. People feel they have the right to ignore red robots because they are turning and the oncoming traffic has to slam on brakes for these idiots, solid white lines are ignored, etc. The problem is that the taxis do it,they show no regard for other road users or for the lives of their passengers. It seems many road users believe if you can't beat them, join them. I just hope these arrests apply to all offenders including taxi drivers

I believe that this a bit drastic but necessary. All rules of the road are so many time bend and broken everyday, that it's no wonder people get ploughed into on the roads. Yes taxis are the main culprits of these laws but they are one of the main public transportation in S.A. and other drivers must be more considered of them and there should be designated lanes for them to move in so that they don't disrupt the traffic flow for others but jumping over, out and back in to flowing traffic. It also becomes clear to me that many other drivers has picked up the habit of driving like them, a kind of ?can?t beat them then join them? attitude. So the sooner people learn how to drive considerate or just drive, the better. And if that means locking people up then I say lock them up.

This is just another case of discrimination. Why is nothing done against the Taxi drivers who behave like hooligans on the road. Get those drivers of the road with the recless bicycle drivers and the roads will be saver.

The government should consider and alternative punishment to fines and arresting offenders. They could introduce an endorsement on driver's licenses whereby motorists are restricted to travel at maximum speed of 60kmh for a period. and maybe banned from using highways etc. A special sign should be displayed on windscreen and rear window indicating that the driver has endorsement. If they break the law under these circumstances they should lose their licenses.

Hi there, I think it's more than fair and I thank the Metro Police for doing their jobs. I sit in the traffic everyday like the good law abiding citizen that I am and see taxis and private cars racing down the yellow line like it's second nature. For what I ask you? We all know how hectic the traffic is early in the morning but for pete's sake... Leave for work earlier if you don't want to sit in the traffic!

We are becoming a nation who do not know the difference between right and wrong. "If somebody else is doing it, why can't I". We are only upset when we are caught! A minor offence against the law is still wrong. A dear family member was killed when a woman made an illegal u-turn. Nothing serious, but it was wrong, and somebody died!

I say fine the living daylights out of anyone who does not obey the law. Cause I can assure you tomorrow they will do the same thing!

Taxi and heavy duty truck drivers do as they please on the roads but nothing happens to them. And our corrupt politicians - Travelgate for one - well they get to repay the tax payers money that they stole for pesonal use...... They should be charged and thrown behind bars without pay. The focus is all wrong and it pays to be criminal in this country. No one accepts it is correct to break the law - but start with the dangerous and serious things. So South Africa has become a huge big joke.

This is what people always wish could happen to taxi drivers. Why is it tough when it happens to them? They even call themselves "minor offenders"! What the hell is that? You break the law, face the consequences. And what is this thing of interviewing offenders? It undermines police work. Don't forget to interview the families of victims of car accidents over the festive season to check up on "minor offences".

i think it was about time the Metro police did something about this so-called "minor offenders". most the traffic jam-ups are caused by their kind that does have the patience to wait at the intersections. i need to see more action being done to stamp-out this holligan-style drivign by the so-called law abiding citizens. taxi drivers are not an excuse... well done metro police, keep up the good work.

I support what has happened. People are not considerate of other road users who stand in the long queues . They just drive to the from and cut in, making the problem worse. Its by time this happened. Any offence is a criminal offence!

I congratulate the traffic department for finally putting down their foot and doing something about the lawlessness that reigns on our roads. I personally each day witness the reckless, negligent and inconsiderate driving at the President Fouche Street-Malibongwe Drive intersection and wondered how long this was going to go on and to what extent these problems was going to grow. I see this only as a start and only hope that the traffic department does not do this as a once-off. Can I suggest the following intersection as it is in desperate need of the same action Cnr of President Fouche Street-Olive Road intersection in Sharonlea this is one intersection away from President Fouche Street-Malibongwe Drive.

Great! It's about time action is taken against people who think they own the road and can drive any way they like. Road markings and traffic rule are their for a reason, and just because someone else (ie. taxi drivers) break them, does not give you the right to do so too. Maybe you'll think twice next time you try and cut infront of someone or skip into the yellow lane.

Someone should sue the JHB Metro police because these idiots don?t know the law. Minnaar always ignores the AA and other legal brains when they say it is illegal to arrest people with outstanding summons. I drive on the M1 everyday and the taxis break every rule in the book and get away. Most Metro cops have been taxi passengers all there lives so they think it is normal to drive like this. I would like to know how many of these cops have valid driver?s licences. U get 6 cops sitting in one area and the taxis will go back on the yellow lines after they go pass these cops. Why don?t the morons sit along the M1 one under each bridge?

I wish i could say I'm surprised, but this is just another example of South Africa's inability to focus on and fix the real problems. Imagine how much more constructively these idiots arresting people for minor traffic offenses could be used. They'd even be more useful if they were used for filling potholes (either interpretation acceptable). This is the reason why there is no respect for the Metro cops and traffic departments. Intelligent life? I don't think so.

I know that i'll probably get battered for thie comment....but i'm going to say it anyway. We 'South Africans'have no regard for the law, yes i agree perhaps these individuals should have been treated better, but i agree that they were locked up! this hsould serve as a great warning to other drivers (myself included) not to take the law lightly. I personally believe and have seen this work in business environments that all big Issues should be resolved by first dealing with the small Issues.

Lets see each morning on the N14 into Pretoria - at least 10 cars (50% taxi's as defined by the unwritten government law). Myabe once a week there are any traffic cops and they only stand there and do nothing. This morning in Vermeulenstreet in PRETORIA at a red robot 5 Taxi's drove over the red robot, and this happens every morning. And yes, no metro. Just down the road in Vermeulen there is a group of Metro almost daily, and they actually some mornings do some work some days, 5%.....
